Atheist Files Discrimination Lawsuit Against Wal-Mart

There are 41 comments on the snafu-ed.blogspot.com story from Jan 3, 2008, titled Atheist Files Discrimination Lawsuit Against Wal-Mart. In it, snafu-ed.blogspot.com reports that:

Christopher Nolan is suing Wal-Mart, charging he was fired last month because he refused to dress up as the store's Santa Claus.

Nolan was asked on Dec. 8th to fill in as the store Santa Claus at the Lebanon, Maine Wal-Mart. However, Nolan is an atheist, and he declined, saying he did not believe in Christmas.

He has no case Santa Claus has nothing to do with any religon. If anything Santa Claus may mean Satan Claws.

It all depends on his job description. If dressing as a character is not part of his job, then he has a case. If he has an "other duties as assigned" clause (pun intended) then he pretty much has to do whatever they say that doesn't cause physical harm. That's how they used to get away with making secretaries make coffee (I know from personal experience).

You're absolutely right. If that clause isn't included, he has a case.

You know, if the guy really didn't want to be Santa Claus, and *had* been forced into it, the kids would have had a disgruntled Santa, which would have been worse than no Santa.

Santa - Spanish for Saint.
Claus - Short for Nicalaus (so I'm told).

Santa Claus - Saint Nicalaus. Saint Nick.

He could have a cause.

Still, it's pretty petty of him.

I don't think there is really much of a connection between atheism and Santa Claus. Nobody is asking him to believe in him, just dress up like the acknowledged fictional character. Sounds like an uppity atheist to me.

Santa Claus *is* a visual representation of a Christian based holiday, he not just any fictional character.

The real question is, "why would they fire him?".
First, it not the normal request and he should have had the right to say, "not interested" and have it end there. You have to think about how many employees Wal-Mart has. Did everyone ask? Did everyone refuse? Did other people get fired? The reality here is that whether or not he's an Atheist or not, it's a moot point. He wasn't hired into the role as his job, they're a retail store. This is more likely either a personal grudge against him or he over-reated and got himself fired due to his own behavior. The case will be decided on that merit alone unless he can produce witnesses to the fact.

I think that it is sad when you quit your job and then try to SUE because you didn't want to do your job in the first place!!!!

Sounds like he's probably an A S S and this was the excuse they needed to fire him!

'Cause the former is only a matter of it occurring to some idiot with an axe to grind. The latter seems, somehow, less likely.
