Anyone eles having problems with a tall,dark haired man wondering around your property late at night,or early(1:00am),n the morning? I have reported this problem to the arthorities,but seems theyr not catching this person..So im warning any&everyone that lives in the rocky creek area to be alert!!,Im not putting up with this,ill be waiting with a gun next time!!

RCR...im off of jessie smith..this is the 2nd time this has happen,the nieghbors has witness it also..,the man is running from one house to the next,nothing seems to be missing,but im not just ganna sit back and do nothing..Gun is loaded and anyone tresspasses will be shot!!

I do not think that coming onto your land gives you a legal right to shoot them unless they are coming into your dwelling...or of a threat.

If someone is in your yard at 1:00 a.m two times, at my house that is a threat. I probably would try to pull a gun on them and call the law. A "peeping tom" can be a real danger, they start out peeping and then it turns to more serious crimes.

However, unless you have proof, you will be arrested and jailed if they are not aught committing a felony. Being on your property is not an excuse for shooting anyone according to the law.

I would try to catch him on camera first, try to identify. Then you will have proof. The court needs proof. Hope you nail the nitwit. No excuse for creeping around at night.

If shot in the right place, It would be difficult for a dead person to argue the self defense claim.

Be sure you understand the Castle Doctorine as it is written in Mississippi law, otherwise you could be faced with manslaughter or (since you posted your plans here), premeditated murder. Here is a link to the full description:

But this is the important part in your case:

1) The killing of a human being by the act, procurement or omission of another shall be justifiable in the following cases:

(e) When committed by any person in resisting any attempt unlawfully to kill such person or to commit any felony upon him, or upon or in any dwelling, in any occupied vehicle, in any place of business, in any place of employment or in the immediate premises thereof in which such person shall be;

(f) When committed in the lawful defense of one’s own person or any other human being, where there shall be reasonable ground to apprehend a design to commit a felony or to do some great personal injury, and there shall be imminent danger of such design being accomplished;

A “dwelling” means a building or conveyance of any kind that has a roof over it, whether the building or conveyance is temporary or permanent, mobile or immobile, including a tent, that is designed to be occupied by people lodging therein at night, including any attached porch;

Note that this is allowed on in defense of a PERSON, not PROPERTY...so trespassing alone won't keep you out of court. There has to be a reasonable pretense of fear for a person's life.

I'm no lawyer, but you really should know what is allowed under the law and what isn't before pulling the trigger. This one is spelled out pretty clearly.

LoosedAlien,you seem as if you may be doing some tresspassing your self and not wanting to get shot. If this was happening to your home you might would feel differently about it. Because seems to me your the only one here opposed to protecting yours an things you've worked hard for..

Ok thanks for all the usefull advice..,ive been from door to door and ALL the nieghbors have had the same problem..,Only worse..the person has to be VERY aware of the area because their stealing gas out of vehicles,tools are missing,and noone can catch them/he in action..,Also nieghbors clame they smell strange odors..Im getting ahold of the sheriff,something must be done!!
