My husband lost his insurance card and was ticketed for no insurance and speeding. I paid his speeding ticket and showed proof of insurance at the local city court, they said the no insurance was dismissed. 2 years later he was arrested for not paying the no insurance ticket. we paid the fine as we did not have proof of the insurance from 2 years prior. Nothing was said about a surcharge. Then he was stopped for speeding and they arrested him because his license had been suspended for not paying the surcharge he knew nothing about. We have been paying that for 3 years. And they assessed another one for no drivers license, stemming from the original one. He was arrested last week because his license was suspended again. He got a letter informing him of the suspention 3 days after he was arrested. So now we start all over again. They said they sent a notice out prior and it is not their fault we didn't get it blame it on the US GOVERNMENT POSTAL SERVICE, not them. Something that important they could at least send it certified mail. That way they know the person gets it or not. How can they get away with this. Shouldn't they have informed him when he paid his ticket. If they had we could have fought it in court.

I have not contacted the ACLU, but I have contacted Lawyers and studied the TX Constition. No response from the lawyers, no surprise! But the wording of the TX DRL and the consequences are so vague that it's enough for them to sqeak by with it being legal.

We all should carry proof of insurance with us when driving, no excuse. From reading your comments, it sounds like your husband has a "lead foot" !

I paid this surcharge faithfully for almost 3 years. I had been out of town for 2 weeks and didn't have access to a computer to pay it, plus I knew I would be home 3 days before the due date. I got home that friday night, went to the website to post a payment and the site was down. No number to call, no nothing. I checked periodically through the weekend and it was still down. I finally was able to call the DPS, which I held for over and hour for, only to find out that I had to call another 1-800 number to a company that received the payments and postings. I remind you, this was 8 in the morning. techinically 8 hours late. I tell the girl I want to pay my usual 89.17 and she states I owe something like 800.00. I asked why and she said I was late. She also stated that they had already sent a recommendation for license suspension for failure to pay. UNBELIEVABLE! After all I went through with my case being dismissed because the prosecution's witness was not there, to it being refiled because they dismissed with prejudice, me having to spend 500.00 re-bond on a new case#, even though it was not my fault, to paying my attorney 2,000.00 for an ALR hearing that I lost, 10,000 trial, paying for a breathalyzer for 3 years, because my trial took a year to happen and the license suspension was 2 years so that cost me another 2500.00, 250.00 in fees to get my new license and my occupational, NOW I AM GOING TO HAVE TO PAY A LUMP SUM OF 800.00 TO REINSTATE A LICENSE THAT I JUST GOT REINSTATED?????

It is a BS deal. I found out clearly, even after your officers do a sobriety test on a hill, do the HGN wrong, would not offer a Breathtest,for some reason had no audio or video, even as I said my ABC's backwards for the dickheads at the time of the initial stop and tests, I could still get convicted simply because of a play on words that I said when I got to the Jail testing. In Texas you don't have to be .08 to get a DWI. DWI is the loss of ANY, whether minimal or an extreme amount of one's mental or physical faculties. It is a CROCK!

I also read and found out from the lady at the DPS that because they were having such a hard time collecting the surcharges they were going to deduct or refund 200.00 for the second year, and 300.00 from the 3rd if you were in good standing. It passed State Senate, but has still not been implemented. I doubt very seriously they will grandfather it for people who paid up like I did after it was passed. They will probably do it for people who are currently "Customer's" which is BS. They ought to retro the payments for those who were eligible. They wont! This has to end. The DWI laws suck. Texas Law Sucks. Tarrant County and ASST D.A. Richard Alpert SUCK!

And if you would have paid the surcharge before going out of town it wouldn't have been a problem. Once again, you fail to take responsibility. Stop with the excuses !

Wow, DJJ. Haven't you ever made a mistake. Chances are this is happening to a family member or friend of yours- calm down. The guy took responsibility and paid. Even the credit card or mortgage company gives you an extension, the TX DPS doesn't.

Jackie, that is VERY severe and wrong! I think your case might best be served in a court of law. There you can present the judge the police report and other evidence.
Just another person the TX DRL has taken advantage of.- The burden of proof is on TX Drivers and it is shitty!

keep your mouth shut you little punk. Everybody in the united states could have been arrested for dwi at some point in their life. I'm sure you are no different. I'm not saying it's right but I doubt you really have the right to judge.

Where are ya'll going to pay these surcharges? I never recieved a notice so I don't know how much to pay or who to pay it to. I went to the DPS and they gave me a number but when I call it they ask for a reference number that they mailed to me, but they didn't mail me anything! I went to two court houses trying to figure out what to do about it and they said it was a different branch of the government. I don't know what else to do.

Update, Mike Krusee's agreed to meet with me Wednesday, August 27th at 2pm to discuss the TX DRL.(He co-authored the TX DRL)
I'm gaining support with the powers above-getting one to author a bill of repeal, and another for suppor/sponsor the bill of repeal.
I've appeared on KVUE News, met with Senator Steve Ogden's and Governor Perry's office to inform them of the negative effects the TX DRL has made on Texas Citizens and to gain their support for a repeal.
Over 1700 Texas Citizens have signed Tamara's petition at: http://www.petitiononline.com/TXDRP07/petitio... , that is great but we need many more signatures! Please sign.

First off, you dont have money for insurance. You get a ticket and pay so much for it, lets say, 300 bucks. THEN you get insurance so you wont get another ticket. Your surcharge comes in, 270 a year for 3 years. What is this shit? first off people who dont have insurance are poor, so how is making them pay MORE money for a ticket that they already paid for helping matters?? Its not, so as the old saying goes, the rich gets richer, and the poor gets poorer. Bullshit all the way around. If you have money then you wont understand, if you dont have money, you prlly already know everything about
