HMMMMM, I was being cute.
Here is what I should of added: Excessive - Exceeding a normal, usual, reasonable, or proper limit.
Surcharge is an additional fee to the cost of the ticket. The amount they require DOES EXCEED A NORMAL, USUAL AND REASONABLE LIMIT.
I know you don't agree with the topic but wait till you are in our shoes. It sure won't be so easy to judge then. Trust me, WE WANT TO PAY OUR CAR INSURANCE! But for some of us, it comes down to paying the car note vs. the insurance OR food vs. the insurance, whatever the reason is. I know you must be a rich person, who has never made a mistake and made to suffer for it. That is wonderful and I hope your luck holds up.

For the few of you that think this is a black and white issue (break the law, pay the fine), I used to think that too. Listen to my situation.
5 years ago I got pulled over for speeding 7 over. One of those small towns with speed traps... Anyways, so I pull out my insurance card, and whoops, it's an old one. My parents who live in a different city had paid my insurance, so they got the cards and had to send them to me. I guess we were both busy and didn't notice it become overdue. I was thinking, no problem, I took defensive driving and paid for the speeding, got that ticket removed, and sent them a copy of my insurance.
Fast forward 5 years. I get a call from a collections agency saying I owed a fine for an unpaid ticket and risked being arrested if I didn't pay. I was shocked, as I hadn't been pulled over in years, and figured it was a mistake. I called them, was directed back to the small town court, and they said I'd never showed them my proof of insurance. I said I did, but it's not like I can prove it 5 years later, so I paid the exorbitant fine.~$300 for warrant fee + collections fee (insurance fee dismissed when I sent them proof again) So I've already paid for something that wasn't my fault, just wanted to get it over with. A month later, yesterday, I receive a letter from the drivers responsibility program. I took care of this, Twice! Why should I owe another 700 for something I didn't do!
Overall I'm being charged about $1200 for speeding by 7 over and being lazy about my insurance card. Fair?
I hope Desi people like her read this and realize the system makes mistakes. I'd rather pay double the "fines" to fight this rather than pay them what I shouldn't owe. It's just wrong.
P.S. This is the 21st century. Why don't they have a way of looking up our insurance, why should we have to carry a card around.
Actually Nathan, the TX DPS can put your License Plate # into their computers in their car and see if you have valid car insurance right then and there.

It's simply another way of nicely extorting money from financially strapped middle class (who could procrastinate). It's much easier to rape you with laws and fines that to outright heavy hand rule you. It's the same reason the mob starting owning casinos. They made more money "legally". What's worse is that 50%(?) of the people not only pay it, but think it's a good idea. We are sheep. Even if you think it's a 'good idea' it's Big Government oppresion. I don't smoke, but I disagree with the sin tax that we pay lawyers and politicians. When they got the cigarette tax approved, it was supposed to help alleviate the burden on health costs. Have you noticed a substantial decrease in your premiums and deductibles. No! As a people, we so gullibly fall for a cliche. They really don't give a shit about uninsured drivers. I wonder if we would ever know how much of that money actually goes to trauma centers and victims - not CEOs.

Real Deal 2012......you failed to deal with the drunk drivers on the road, and those without insurance.

What do you do to prevent a middle class, financially strapped, drunk driver from killing your son, daughter, or maybe your neighbor ? Do you slap their hand and say "please don't do that again" !

No sympathy here.....pay up !

To all of you with Desi's attitude, piss off. I DID do the crime, and I DID pay the fines. I even TOLD them I did the crime. I accepted the risk of having to pay the fines when I left the house.

And then off from out of the shadows comes
BIG MEAN MISTER SURCHARGE SYSTEM, and he starts slapping me around with his massive bundle of BS!

Who is the State thinking they can just create a system to go around blanket-spanking everyone who ticked them off.... after the fact.

The state says, "You did this, but it's all good now bro, we cool.", then turns around. While the State's back is turned, his homie the DRP steps up. "WTf? I heard you had some beef with the state, pay up." <-- WHAT?!?! Why should I pay?

I've done my time Sir.

I think the accident damaged your brain to the point that's all you know how to say.

two points:
I did not say what my surcharges were for.

Me not being able to work means your free ride won't last long.

I do not drink, and I have had insurance on my vehicle this entire time I haven't had my license just so it can set on my lot without the state stealing it. You have to have insurance to register a car, and cars have to be registered to sit in public view.

I do not like paying for your free ride for nothing, and I find your constant yelling here very offensive. You think you know me? I know you.

Hello everyone! The TX Driver Responsibility Law is a very little known law that requires Texans to pay over $700.00 (if you pay upfront) for certain traffic violations and/or points.
I received a ticket four years ago for having no car insurance. I did the crime and paid the fine. I was released from all fines and fees from the TX DPS. However, the TX DRL gives the TX DPS the right to require over $700 MORE from me and suspend my Driver's License if I don't pay. TX DPS doesn't have to notify me and I can't seem to find the appeal process. This is a violation of our constitutional rights!

I just spoke to the Tx Dept Public Safety Surcharge Persons:::According to them what we pay the COUNTY has NOTHING to do with the STATE. They don't consider it DOUBLE JEOPARDY or EXCESSIVE FINES. There has to be something we can do about this. I bet they would be shocked to see everyone going to Horse and Buggy to get around because the STATE of TEXAS is money hungry I just wounder how many of the LAW MAKERS have had a DWI and didn't have to pay this!!! I guess we will never know. If you are a Habitual offender I could understand but FIRST TIME!!!! Maybe I am wrong but I don't think so

Marie, the problem is that you talked to a DPS rep. They are the one's taking your money. They are not going to tell you otherwise. Plus they, just like anyone else, are allowed to lie to you. Just like officers or any other agent, if they are not on record in court, they can say anything. You are already charged with knowing the laws yourself. They WILL NOT help you, and they ARE allowed to say anything to get you to comply to the job they have at hand. There are no laws about lying while not on a court record.

Next, the state can think all they want, but their statues still have to be within constitutional law. Double jeopardy was written into constitutional law for this exact purpose. So that we would only have to pay one set of punishment per crime committed. Now tell me, when I have a fine ordered by my City under the statute authority of The State, how can ANY other authority/body/group/associati on/etc. charge me for the same offense? Or even charge me a separate amount concurrently? Point being, when I am issued a fine, money only goes one direction.

Operating only under the pretenses the State is taking at this moment, I MYSELF could come back around and start charging all of you for your crimes committed a THIRD time!

If the State issues statues that cause you a fine, then MSB (a private corporation) comes around and charges you again, why can't I do the same and just charge you all as well?!?

I CAN NOT! But, all the same, MSB can not either. Hell, even if the City gave you a fine, even the STATE itself can not come back and ask for more. The fine was given under the authority of the STATE.

Point being, the surcharge system is a third party system only invoked AFTER the situation has been completely settled. I am proof of this.

It is double jeopardy.

I'm sorry I am such a terrible person not wanting to pay my surcharges, and not allowing 49.5% of that money to go to helping medical centers be prepped/certified for trauma centers....for kids.

If the State had just asked, I would have just freely given this money over. It's all about the principle of just taking my money like they have a right to it, or can force it away from me.

Just ask, I will bend over backwards to help you with whatever I can manage.

Take a page from your own preaching, and YOU stop crying about how bad your life is.

QQ is all we have seen from you here.

"Shit Happens", but that doesn't mean the repercussions have to be unreasonable. I didn't even do anything to you, why are you mad at me and everyone else here?

Please reply so I will have a few minutes of entertainment for tomorrow!

What's unreasonable is your driving drunk !

Pay Up ! Stop your crying !

As for my life....it couldn't be better ! I don't have to work because of past investments. I go to the Caribbean several times per year and can do or buy anything I want.

Thank You Domer, I am trying to figure out a way to get this to our local News Stations, and the Papers. Alot of persons do not realize this is happening, and also the persons speeding. I just read on the internet thru a Lawyers info, that if you just go in and pay your fines this will happen, I had a Attorney,( not that he did me any good) His call to me is they are offering you a fine and court cost to plea guilty and end this now. Wow didnt tell me I was gonna get this Surcharge. If I would have known this I would of fought it.

Oh, this explains why we should allow uninsured people to drive on the streets so they can crash into the law abiding drivers and not get their vehicles repaired or their medical bills paid. I have seen people handicappedand and even killed in accidents only find out the others that caused it had no insurance. If you can't afford to drive legal, you should not be on the road at all. No sympathy for uninsured drivers here! Get the insurance or pay the fine or go to jail!! My opinion is if you get caught driving without insurance the police should impound your vehicle and take your butt to jail!! If you can't pay the fine, the wrecker, storage obtain insurance the state should aucion off your vehicle and the proceeds should go to injured victims of uninsured motorist accidents. It is people like you that make everyone elses insurance so costly. If you can't afford to drive legally maybe you should consider moving somewhere where you can ride the bus or WALK. And as far as compassion goes, I believe it should be for all those people who have lost their livelyhood, health and life savings because of deadbeats like you that can't meet the minimum requirements to operate a vehicle on our roads. If you can't pay for insurance, don't drive!! THE SAD THING HERE IS THAT YOU WILL CONTINUE TO DRIVE EVEN IF YOUR DRIVERS LICENSE IS SUSPENDED STILL LEAVING THE PUBLIC AT RISK. Contrary to what you think most law abiding drivers have to do without many things in order to make their insurance payments. They will support this legislation to make the consequences so bad for driving without insuranse to keep them safer and make their own rates lower. <quoted text>
YOu my friend are an ASS if you think that moving closer so you can walk is an option for people who can't afford to pay for the double jeapordy surecharge or the insurance that caused it. Walk one mile in my shoes, I am a father of two who recived all this BS surcharge crap for driving a customers vechical ( I am a mechanic) who had bad tags and no insurace. Now I have no licence now, I lost my job because i couldnt drive the company service truck or test drive my jobs. Now i work for half of what i used to and have recived 15 cases for just trying to feed my family up until this my children had never been on medicade and we never ate one crumb of food stamp food. Now your rich ass is paying for my kids healthcare and my 750 bucks per month in food. So put that in you rich ass pipe and smoke it.

Ok Everyone! I'm posting this on this page too. Desi loves to be a maron, Just stop acknowledging it. No one cares about Desi. She is rich, perfect and NEVER made a mistake.(that is what she conveys to us)Though it is sad that Desi is older and re-butts like a 4 year old on the playground. But we laugh, move on and remember that we don't want to be bitches like her and we fell better!
This law is going to be repealed and when it does, we can laugh even more at her! So, no worries
