It Seems that the florida Child Support agency and the Florida Courts are confused. How does it work that a father has to "pay till the day you die" Even though final judgement advises of children's birthdate but does not contain an emancipation date.( which wasn't required when the papers were finalized) It seems no one in either agency can do the math!

its not just fathers..its anyone who pays child support...i recieve child support for 2 of my daughters...about 6 months before my oldest turned 18 we got a letter from child support saying that child support would automatically stop when she turned 18 unless i gave reason otherwise. i had to fill out a form showing that she wouldnt graduate until after her 18th birthday and send something from the school showing her projected graduation date. at the same time, since her mother was behind nearly 5 grand from when she was younger and wasnt paying, i had to also request a hearing to continue child support even after she graduated until the arrearage is caught up, which at the current rate that they have her mother pay wont be until she is 22 if i remember corectly.

It should until the age of 18 or until completion of HS up to one year over the age of 18. Until he/she marries, joines the military, or doesn't something else to get emancipation.

scott1,
I received a letter from the child support office today stating the support will stop my son's 18th birthday, 8-29-08. My ex owes over 20,000.00 in back support. What do you advise that I do?

That doesn't take him off the hook for the past due.

find out where your local child support office is, go down there and tell them you need to file for child support to continue after your childs 18th birthday because of the arrears amount...they will give you a form to fill out, and they will verify the amount past due. you should then hear from them not long after giving you a court date to go in front of a judge to get the support conntinued...it is usually continued at the amount being paid now.

I feel like the system is working for the non-custodial parent because I have been waiting to get a court date to receive anything from the father of my child. I filed the case about 14 months ago and still don't understand why the case is being sent to court when the paternity isn't an issue and they have all of his earnings; why then am I waiting to see a judge?? They told me that it could take a year before it even reaches a judge. I am so frustrated sometimes that I just want to cancel the case and continue the struggle on my own..

what to do? I have had an order in effect for over 2 years now. What a joke! When I call the help line, nobody seems to be able to give you an answer. When I go to dept of rev they inform me all the information I have given was never processed right. It seems futile. Does anybody know at what point do they actually arrest for non payment? OR Is there anyone who knows of an attorney or legal services to help someone with limited income?

I had my drivers licence suspended for 8 years and neither child support services or DMV seemed to be able to assist in re-instatement, unless I FLY TO FLORIDA and come into one of the DMV offices in person....I live in HAWAII....WTF?!

It depends on the state you're in or your divorce decree.

StillWaiting...my son went thur the same thing.....15 months,..and 2 emails to Our Governor....resulted in him getting a mere $54@week,..becuz MommyDearest is recieving unemployment benefits...and mind you she works in the medical field,..so,..unlike ppl that actually need unemployment benefits,..she's just riding a chain.....and the back child-support got dismisssed,..becuz my son didn't take his proof of income for the last 2 yrs,..and daycare bills, loss of work etc, for my grandson,..has a medical problem that has required going to the Dr's office at least once a week for the last 3 yrs. My son spends more in gas just going to get my grandson medical care than this hefffer is paying,..not counting the special foods that have to be bought and lunches made, and time off of work to go to the school,..everyday...Wonder why the Judge didn't get the pic,...MommyDearest,..doesn't have custody...for a REASON...my advice....send emails call rite,..and b*tch like hell,..until U get that court date,..and take ALL YOUR PROOF with you....Good Luck!

My child has already turned 18, my child support payments are up to date, i was not in arrears, The child support office told me that it was supposed to stop but it's still coming out of my paycheck, how long do i have to keep paying after it was supposed to stop. Very frustrated that i am over paying what i was supposed to and not getting any help from child support enforcement at all.

My daughter graduated HS this past spring and I was told that I have to show proof of graduation at the court house to stop payment as ordered by the court. the problem is that my ex-wife nor my daughter will provide me with a copy of the transcripts or diploma for me to do so. I call her school and and explained my situation and they stated that when the student graduates, the paper work becomes THEIR property and can ONLY be released with their permission. Since they are not cooperating what would be my options other than consulting with a lawyer??

I am paying child support for my son who turned 18 this past January. They said it was because he in enrolled in a technical school and I would have to pay until either he graduates or turns 19. Now my problem is my son was arrested last week and charged ,as an adult, with 5 felonies and 2 misdemeanors. He is currently sitting in jail and I am still paying child support. Is there any way to get it to stop because he is incarcerated?

I was wondering how do you drop a support case before it ever goes to court? I have been waiting over a year and it's just not worth anymore trouble.
