Why are there Four foot deep pools without the required 4 foot fence and lock

There are a lot of pools that are unprotectedBy a four foot fence.What if a small child just fell in and drowned?What if it was YOUR child that drowned because of ignorance?

I was told that technically if the pool is 4ft tall that is the same as having a 4ft fence. Said by county employee that oversees this.

I understand about protecting children and agree but I know some do not want to put one up or cannot afford it yet. Some say its their property, so there is nothing you can do about it and that people should keep an eye on their children.

my opinion is that YOU do not need a pool without fenced in yard and gate with a ( NO TRESPASSING )and the gate locked when no one is at home!! we have a pool and never allow any children in our yard.but we do have grandbabies so thats all we need!!they are 3-8yrs old and REGARDLESS no one swims without a life jacket and they know we never swim alone!!! so yes people kids will wonder!!! especially not supervised and I know you should be able to do on your own property!!! and when there becomes a accident then you will think about all of that!! I also hope you have insurance.(ownership-or renters)because you will need it if some child falls in without a fence or locked gates!!!

Most people do have home owners insurance. Renters are only allowed to put a pool up if they are renting to own or if the pool can be taken apart. Technically speaking, if a child drowns in another person pool, it is not the homeowners fault..it is the parents for not keeping an eye on the child. Do your homework. This is coming from a law student and criminal justice degree. It is sad that parents cant keep an eye on their kid and then blame someone else for the mishap.

well thats not true,or at least they havent been caught or called in on because up at northwood loop which is nothing but apartments!! and the one you can see from 127, is a big pool and does not need to be there.

For those homeowners that have pools and are too cheap or too ornery to build a fence, I suggest they google the term "attractive nuisance" and then build a fence before some neighbor's kid gets hurt and the homeowner gets his or her ass sued off. Because the homeowner WILL be the one found liable.

If the pool can be taken apart, or if the landlord is okay will the pool..they are allowed to have it there. I've seen this case (in studies) before and it might be different where I live now but in most cases it is NOT the homeowners fault. I do agree with you that a fence should be up; however, it is the parents responsibility to keep an eye on their kid. Personally, if you have a kid and care for it, you would want to watch over them. Especially in todays world where people kidnap them, get hit by a car and other worse things.

I used to own a pool and having a 4 foot fence around a pool is stupid, of the child can't climb the 4 foot fence what makes you think he can climb a 4 foot pool? I can understand having the entrance ladder blocked off so the child cant get into the pool but not the whole pool. And if a child is going over to another property and the parents don't know nor are they keeping an eye on them then THAT'S the problem. If people don't want fences up around their pool that's their business they pay for that place and of you want to buy the expensive material to put around it then do it.

Who are you to tell people what they need thats the probelm with the world today people like you think that you can tell people what to do and everything else. If you care so dam much about about the fence probelm take your azz to one of those house with the pools you are cryin about about and help them with some $ to have a fence. Plus if you really care so much you could be part of getting that dam public pool in this town so no one would have to go buy one and plus the kids in this town could learn how to swim but no get on here and wine. put your head under water and hold your head under so we dont have to hear you.
