'Shea' loophole closed in drunken-driving law

Gov. David Paterson signed legislation Monday that expands the list of medical professionals authorized to draw blood from alleged drunken drivers without physician supervision, closing a loophole that has allowed some intoxicated motorists to escape prosecution.

I was just thinking about this tragic event the other day. I saw a dune Buggy and remembered "Herbie Reynolds" Mr. Shea's killer.

I knew Mr. Shea, I grew up in Lake Placid I went to school with Jimmy and my family is friends of the Shea's. How tragic, his grandson was the third of his family to win an Olympic medal but he had been killed just before and never got to make that wonderful, proud phone call to Jimmy.

I also knew Herbert "Herbie" Reynolds, he was a few years above me in school but we all knew the purple dune buggy. It was a multiple shock to know the victim, his family and the killer. How sad that the penalties for murdering someone with your car...WHILE DRUNK...are so lax. I am glad Governor Patterson signed the bill closing the loophole. There should have never been a loophole in the first place. Murderers shouldn't be protected by loopholes.

Drunk driving IS attempted murder, period.
Driving drunk and then killing someone IS murder, period.

It's high time drunks be treated the way they ought to be treated. I do not care if they have an "illness" that is a lame excuse for killing and maiming people. Psychopaths have an illness and they don't get away with as much as drunks do. Alcohol abuse is first a crutch and then an excuse and then an illness and it's all of their own choosing. Surely as someone who choses to purchase a gun, goes to an office building, chooses to open fire and kills people.

If you are drunk...and you know when you are drunk, saying you didn't know is a cop out...if you are drunk and you get into the driver's side of the car and drive it, you KNOW you are looking to maybe kill or maim someone and you don't care who.

I knew a drunk, when Princess Diana was killed, he was proud. He told me that drunks, like him, change the world and no one does anything about it except sing songs, slap wrists and try to be understanding of their illness. He bragged that if someone wanted to be a serial killer all they had to do was drink and drive and nothing really terrible would happen to them. They'd get some time...maybe but usually it would be a slap on the wrist and they'd be free to kill again another day. Taking someone's license doesn't stop them from driving if they really want to drive.

How scary it is that he was right!!!

Murder must be premeditated. Being stupid and careless is not murder. There was no intent that day to drive his car and kill someone. Say you hate someone, you go to your home load you gun travel to the persons home and shoot and kill that person, that would be murder.

Excuse me but what is NOT premeditated about knowing that the potential of killing someone is more than greatly increased when you get into the driver's seat of a car and drive it while drunk? If it were not then it would not be a crime in the first place.

Hate is not exclusive to the motive for a premeditated murder, callousness, greed and selfishness all apply.
There's something pretty selfish about getting into your car, drunk and putting other people's lives at risk.

You drive drunk people can be killed by you.
Driving drunk is a choice.
You choose to drive drunk, you choose to put other people's lives at stake for the fun of it.
Therefore, if you choose to go out to drink and you choose to not make any other arraignments and you choose that you'll be driving yourself home drunk then you chose to potentially kill others.
Sounds like premeditation to me.

It's not as if this is a brand new concept. That's like saying that someone who picks up a gun for whatever reason, aims at someone's head shoots and kills them can say, "well, I didn't know that could happen." It's not as if it's not on TV, in schools and on the radio for over 25 years that drunks kill innocents when they drive.
So, it is obviously premeditated.

May the only person you kill, when you DO kill someone, be yourself.
