As you read this remember that Paul Sale and Charles Clark reinstated Brett Braun when the Aldermen all voted NO to rehiring him. This is just typical of the reign of Paul Sale. Also remember ALL of these civil suits are when PAUL SALE was in office. If you vote for Vandonsol, YOU WILL GIVE A VOTE TO PAUL SALE and keeping the sexual harasser Charles Clark.

Plaintiff alleges that Defendant Patrick used excessive force and unlawfully assaulted, battered, arrested, caused the detention
of, and otherwise unlawfully seized Plaintiff, in violation of his rights, including those secured and protected by the Fourth and Fourteenth Amendments to the Constitution of the United States. Plaintiff alleges that Defendant City is liable for Plaintiff’s damages because it failed to train, instruct, supervise, control and
discipline the officers of the City of Lake Ozark’s Police Department, including the Defendant Police Officers, and said failure was a result of or part of the official policy or the
custom, practice and usage of Defendant City and that said custom, practice and usage caused the deprivation of Plaintiff’s rights secured under the United States Constitution, the laws of the United States, and the laws of Missouri.
12. At the same time and location, Plaintiff was present as a customer in the store.
13. Upon entering the store, Defendant Patrick approached the counter where Garrison and Plaintiff were conversing.
14. The remaining officers entered the store from
Garrison’s living quarters, located in the back of the store.(BREAKING DOWN THE DOOR TO HIS RESIDENCE)15. Garrison stated that he would come around the counter to speak with the officers. Garrison did not resist arrest in any way.
16. Defendant Braun shot Garrison with a tazer gun and took him to the ground. Officer Braun used the tazer gun to deliver two separate five-second-long cycles of electricity through Garrison’s body.

17. After Defendant Braun shot Garrison with the tazer gun, Defendant Patrick grabbed Plaintiff by the arm and pushed him against the wall.
18. Plaintiff immediately informed Defendant Patrick that Plaintiff was not resisting and that there was no need for the excessive force.
19. Defendant Patrick then continued to forcibly hold Plaintiff, place him in handcuffs, lead him outside, and order him to sit in the dirt. Defendant Patrick did not give Plaintiff any
explanation as to why Plaintiff was being arrested.
20. After approximately 10 minutes, Defendant Patrick approached Plaintiff and asked whether Plaintiff had any identification on his person. Plaintiff responded that he did have
identification and that he did have a pocketknife in one of his pockets.
21. Defendant Patrick then raised Plaintiff off the ground so that Defendant Patrick could remove Plaintiff’s wallet and the pocketknife.
22. Defendant Patrick then led Plaintiff to an alleyway next to the store and forced Plaintiff to sit, while still handcuffed, in the dirt for approximately another fifteen minutes.
23. Defendant Patrick returned, ordering Plaintiff to stand, which he did. Defendant Patrick then removed Plaintiff’s handcuffs.
24. Defendant Patrick then asked Plaintiff to empty the contents of all of his pockets and questioned him about the contents of his pockets, including a money clip containing United States
currency. None of the contents of Plaintiff’s pockets were illegal.
25. Defendant Patrick then subjected Plaintiff to a barrage of questions as to whether Plaintiff had ever been arrested and whether Plaintiff was engaged in any illegal activity. Plaintiff
answered that he had never arrested and that he was not engaged in any illegal activity.
26. Defendant Patrick then instructed Plaintiff to remove his jacket, socks, and shoes, and unroll his pant legs.
28. This search of Plaintiff’s person took place next to the portion of Missouri Highway Business 54 in Lake Ozark commonly known as “the Strip.” This portion of said highway is a busy thoroughfare lined with businesses and is a common tourist attraction.
29. Defendant Patrick’s search of Plaintiff’s person was at all times conducted in an area visible from the portion of Business Highway 54 known as “the Strip,” and Plaintiff’s detention, search, and questioning were observed by an unknown number of members of the general public.
30. Plaintiff was highly embarrassed, offended, and personally degraded as a result of being detained, searched, and questioned by Defendant Patrick, especially in such a public area.
31. Plaintiff was detained for a period of approximately ninety (90) to one hundred twenty (120) minutes by the Defendant Police Officers.
32. Neither Defendant Braun nor any other member of the Defendant City ordered Defendant Patrick to release Plaintiff from custody at any time.
33. The search warrant for Garrison’s store did not authorize any search of Plaintiff, and Plaintiff was not engaging in any illegal activity when Plaintiff was arrested.
34. Defendants Braun and Patrick had no reason to suspect that Plaintiff had committed any crime at the time when Plaintiff was detained.
35. During the search and seizure of Plaintiff’s person, Defendant Police Officers unreasonably, needlessly, and intentionally caused Plaintiff to suffer emotional harm, physical discomfort, public embarrassment, and personal degradation.

COUNT I: EXCESSIVE FORCE BY DEFENDANT PATRICK COGNIZABLE UNDER 42
U.S.C.§ 1983

41. The acts of the Defendant Patrick as stated herein were intentional, wanton, malicious, evil, and oppressive, or involved reckless indifference to the federally protected rights of Plaintiff, thus entitling Plaintiff to an award of punitive damages against Defendant Patrick.
42. Defendant Patrick knew or should have known that detaining, searching, and interrogating Plaintiff without a warrant, and with no reason to suspect Plaintiff had committed a crime, was
a violation of Plaintiff’s right to be free from unreasonable searches and seizures as guaranteed by the Fourth and Fourteenth Amendments of the United States Constitution

COUNT II: FAILURE TO SUPERVISE, CONTROL, AND DISCIPLINE DIRECTED
AGAINST BRETT BRAUN COGNIZABLE UNDER 42 U.S.C.§ 1983
44. Plaintiff fully incorporates the allegations contained in paragraphs one through forty-three as if fully set forth herein.
45. Defendant Braun investigated, organized, and executed the search warrant of Paul Garrison’s store on April 5th, 2007, during the execution of which Plaintiff was detained and searched.
46. Defendant Braun had a duty to supervise, control, and discipline Defendant Patrick in order to prevent Defendant Patrick from violating the constitutional rights of any individual, including Plaintiff.
47. Defendant Braun, in executing said search warrant, had a duty to ensure that no individuals, including Plaintiff, were detained in violation of their constitutional rights during the execution of Defendant Braun’s search.
48. Defendant Braun failed to perform his duties as described herein, and so was an immediate and proximate cause of Plaintiff’s injuries as set forth herein.
49. Specifically, Defendant Braun knew or should have known that Defendant Patrick was detaining, searching, and interrogating Plaintiff in violation of Plaintiff’s constitutional rights.
Defendant Braun further should have ordered or recommended that Defendant Patrick release Plaintiff in order to protect Plaintiff’s
constitutional rights.
50. The acts of the Defendant Braun as aforedescribed were intentional, wanton, malicious, evil, and oppressive, or involved
reckless indifference to the federally protected rights of Plaintiff, thus entitling Plaintiff to an award of punitive damages against Defendant Braun

52. Defendant Braun acted unreasonably and in reckless disregard for the truth in wrongfully seeking and securing a searchwarrant based on inaccurate, inadequate, and false information for
one or more of the following reasons:
(A) Defendant Braun began searching Garrison’s trashbased solely on information allegedly given to another officer by an alleged confidential
informant.
(B) Defendant Braun relied negligently or recklesslyupon the results of a field test that indicated a bright pink fluid found in a syringe in Garrison’s trash contained heroin. Laboratory tests have since confirmed that the pink fluid in the syringe actually contained no illegal substance.
(C) Defendant Braun intentionally falsified the field test results on the bright pink fluid in order to obtain a search warrant for Garrison’s property.
(D) No laboratory test ever indicated that Garrison’s trash contained any illegal substance.
53. The illegal search and seizure of Plaintiff’s person committed by Defendant Police Officers was based on the improper search warrant and was in violation of clearly established law.
54. The illegal search and seizure of Plaintiff’s person was not objectively reasonable.
55. As a direct and proximate result of Defendant Braun’s execution of the improper warrant, Defendant Patrick subjected Plaintiff to an unreasonable search and seizure of Plaintiff’s
person in violation of Plaintiff’s constitutional rights.
56. If Plaintiff prevails, he is entitled to an award of attorney’s fees and costs pursuant to 42 U.S.C.§ 1988 (2000).
57. The acts of Defendant Braun as described were
intentional, wanton, malicious, evil and oppressive, or involved reckless indifference to the federally protected rights of Plaintiff, entitling Plaintiff to an award of punitive damages against Defendant Braun.WHEREFORE, Plaintiff prays for judgment against Defendant
Braun for compensatory and punitive damages in an amount which is fair and reasonable, plus the cost of this action, attorney’s fees,
and such other relief as the Court deems fair and just.
COUNT IV: FAILURE TO INSTRUCT, SUPERVISE, CONTROL, AND DISCIPLINE DIRECTED AGAINST THE CITY OF LAKE OZARK COGNIZABLE UNDER 42 U.S.C.§ 1983

58. Plaintiff incorporates by reference as though fully setforth herein paragraphs one through fifty-seven.
59. At all times herein alleged, there existed within the City of Lake Ozark, Missouri’s Police Department policies or customs that allowed or were deliberately indifferent to unconstitutional
violations of the civil rights of citizens of the United States. These policies or customs were so persistent and widespread that they had the effect and force of law.
60. Defendant City was vested with the authority to train, supervise, discipline, and otherwise control the officers of the Lake Ozark Police Department. Defendant City failed to change its
policies or customs by failing to train, supervise, discipline and control the Defendant Officers.

REMEMBER THESE TWO WERE PART OF THE PAUL SALE GESTAPO THAT HAD THE CITIZENS OF LAKE OZARK AFRAID TO EVEN BE ON THE STRIP AT NIGHT FOR FEAR OF POLICE BRUTALITY.

A VOTE FOR VANDONSEL FOR MAYOR WILL BRING ALL OF THIS BACK TO LAKE OZARK. PAUL SALE SAID HE WOULD NOT GIVE UP GETTING THE CHIEF MAPLES FIRED.

REMEMBER, PAUL SALE'S SON WAS ARRESTED, BY CHIEF MAPLES POLICE FORCE, FOR BREAKING INTO AN ARCADE THIS SUMMER, AND SALE IS MAD ABOUT THAT.

Read the above comment VERY CAREFULLY. This is what will happen again if VanDonsel gets in as Mayor. Putting Paul Sale in his seat and FIRING THE CHIEF OF POLICE MAPLES.. SALE HAS MADE THAT REMARK ALL OVER TOWN. REMEMBER what it was like when SALE and his Gestapo police force ran this town.

Since Johnny has been elected all of the SALE corruption has been CLEANED UP. Rives the crooked Prosecuting Attorney got caught with his STICKY fingers, No telling how much he got by with. All the corrupt cops are now being sued for their actions. Remember all the SEWER SPILLS that CLARK AND SALE knew about and weren't reported. That the citizens of Lake Ozark are getting to pay for now. Johnny has made sure all sewer spills are reported now. Even though the economy is slow, there is still construction going on (Twigs, Baxters) and developers are continuing,(Pruitt). Remember the SIDEWALK in front of the TURD motel cost the citizens. If the city has any money, SALE wants to make sure it is spent and everyone knows Vandonsel is just a SALE PUPPET. Sale knew he couldn't win running for Mayor so he PUSHED Vandonsel out there to TRY to win. Vandonsel wants to keep the SEXUAL HARASSER CLARK in city office because VD knows he ain't smart enough to know what is going on. Remember all of this at election time.

Everyone knows Vandonsel is his own person he doesn't need someone to tell him what to do,(not like the mayor we have now). And all the construction that will be going on has nothing to do with the mayor, he the reason nothing is happening in the last 2yrs. He doesn't understand anything, just ask him and you will get some stupid answer and you will go away wondering what the hell his he talking about. He is being called the Do Nothing,Don't Know Nothing Mayor.

Why don't you comment on the lawsuits that the city is facing because of the SALE/Clark administration? You come on here and say all kinds of crap about Snoopy but you can't call that person a liar when it is PRINTED above. All you want to do is defame Snoopy. You can't face the facts that YES Vandonsel has to have SALE and CLARK and RIVES around to tell him what to do. Everything that comes out of his mouth sounds like one of them... I suppose you want to see the city go back to the way it was when SALE was mayor.

You never mention about all the other law enforcement that were there like the Drug task force and other county officers(why is that?). Your so full of hatred for these people you can't even think straight. Thats why nobody pays any attention to you.
And as for Vandonsel you do not know the guy at all, because if you did then you know that the guy doesn't need anyone to tell him what to do.
I watch him in meeting he on top of everything that's going on, and not afraid to speak up. Not like the do nothing, know nothing mayor we have know. Not like the puppy dog on a rope that we have now. What a wasted last 2 years.

vandonsel is part of the Sales gang and I hope the smart people of Lake Ozark will never again let these crooks get complete control of our city look at all they lives they have destoryed are demaged. guess what they want have to pay either it will be us the taxpaper because our money is used to pay the Insurance company to pay the lawyer to defends the suits and we need to admitted that all of them should be settled in favor of the people filing the suit

I believe Chief Maples had just started as Chief and look who he had for officers. Braun the one that initiatied the search order going through Pauls trash and finding nothing., Patrick, Heiser and all the other losers. He was taken in by these corrupt cops. They sure didn't last long after he found out about them did they??

Look what they cost the city. and the big one is yet to come. Don't blame the chief for that one. He has cleaned up the police force to where it is again safe to be in this town and young girls can at last walk the strip and not be harassed by policemen like Heiser.
