My son started work for a construction company in Clute on memorial weekend..he expected 2 days pay for that this past friday..no check,no phone call, nothing! After blowing up his phone he called back last night(sunday) and said he was going to call back in 30 min. No call back. It is now Monday morning and back to his voicemail once again.
Is there a solution ? A complaint to be filed somewhere?? He sure came across as legit.

I cant even imagine how the pay for the next week will be collected.I forgot to mention there are 3 other guys from that job site who are waiting for pay also.
I was reading the Facts and noticed in the indictment section that two of his sons(which work for dad) are in there, both are charged with aggravated assault and robbery...not only shady company but shady characters as well.
By doing a jail search on the sons i think i have discovered where this man lives...i have the address!! Could be dangerous..no?

A big thank you to Mark Wicker for the invaluable advice. Obviously the legal way is always right.
A certified letter, he has 10 days to respond,after that criminal charges can be filed for theft of services.
This man is a crook posing as a christian and upstanding business man.

A claim was made with the texas workforce commission and an investigator got on it right away...it was determined that Martin Erivia must pay the wages,he had 30 days to respond and did not...he was fined and a lien was ordered...twc will continue to persue it and hopefully collect soon.
So i do i have a clue or two

When a wage claim is received by the Labor Law Section, the claimant is notified in the mail that it has been received and is given an estimate of the date by which the Texas Workforce Commission (TWC) will issue a Preliminary Wage Determination Order (PWDO). Simultaneously, the employer is notified that a wage claim was filed, and a response to that claim is requested.

Once a wage claim is in the process of being investigated, an investigator may contact either party if additional information is needed.

Based on the investigation, TWC will issue a PWDO. Both the claimant and the employer will have appeal rights to the PWDO.

If you choose to appeal the PWDO, you must send a written request within 21 calendar days from the date the PWDO is dated. If you file your appeal by fax, then the appeal date shall be the date and time the appeal is received by the Agency. If neither the claimant nor the employer requests an appeal or judicial review, and if the amount ordered due is not submitted by the employer within 30 days after the date of the PWDO, the PWDO will become a Final Order. Our Collections Unit will pursue collection action of the amount from the employer.

Wage amounts awarded in wage claim cases are not drawn from state funds. Any monies that are determined due to a claimant must first be collected from the employer before they are paid out.

If the money cannot be collected, then a lien may be filed as a permanent record of the debt owed to the claimant by the employer. Any money collected on a claimant’s behalf will be forwarded to the most current address we have on file. It is the claimant’s responsibility to notify TWC in writing if his or her address or telephone number changes at any time.

I recently got screwed over by this man and will tak what ever steps I need to make sure this doesn't happen to anyone els the "company name he went by with me was scout construction services I know where he lives and I know his wife whitch she is a good person but he has the wool over her eyes. I plan to take him to cort and if I can find more ppl he has screwed over mabey he qill be shown for the con artist he is

Martin Erevia took thousands from my elderly father for a roofing job he never completed. What little work he did had to be redone by a reputable company. Erevia is a bad and dangerous man. He has a warrant out for his arrest for the revocation of a felony theft probation. If you find him let Brazoria County law enforcement know. He's a thief, gangbanger, and probably also a drug dealer. We're looking for you, punk.
