Only people on here attacking loss prevention associates have come into contact with them, whether u were stealing or ur son/daughter...ect. Damn hating so hard on their career. Rent-a-cops... really??? Is that what you think? Man...if only you people knew. I know LP that have been stabbed and followed home, and you're going to sit here and disrespect them? That's pretty hateful. And to the original post, is it possible that youre child was being extremely disrespectful or trying to run or trying to fight? Would u be kind and respectful back to them if u were in the LP's shoes? I bet in whatever job u do, it's so hard to show someone rude respect... its hard and some of us can do it better than others. But some people say terrible things. I'm just saying.

O.K. blah from AZ. Now that I have time to respond to you I will. I'm saying the LP @ WM are trying to be cops and they are not. I have never or have my kids be in trouble with them. I too have seen whay they go through but to stop someone for stealing 10 20 item is worth thier life I dont think so. I'm saying dont try to be cops you dont have the training. My husband is a DEA agent, brother LAPD cousin US Marshall. So i know the training they go thru. My retail stores dont give the right training or equiptment to the LP's. So dont try to be cops.

They said he didn't, just that he and his friend were opening packages. This wasn't about me trying to convince people of my sons innocence, it's about how LP treated a minor. Look up Wal Marts past LP issues and you will see what I'm talking about. And who here is really qualified to pass out parenting advice. You guys have nothing better to do than talk shit to people after reading half of what was said. And sorry LP is a joke shitty pay for protecting someone elses shit. You are just like the rest of the people on this site, Pussy ass people who don't have shit to say unless their in front of a computer. Loser Your son and his friend were going through Wally opening up packages and this is OK in your mind? IF that is all they were doing it still isnt OK. That in itself can make the merchandise worthless. I dont know about others but I dont want to buy electronics that have been opened. That costs the store money which costs everyone money because prices go up... just like shoplifting does. Your son was wrong either way. Keep defending his bad behaviour and see what kind of adult he ends up being. I have seen kids like this in the stores before. Sad. Parents condoning this kind of rude and wrong behaviour and then blaming the authorities when their children misbehave.

Krista619 wrote: Has anybody had any dealings with the Loss Prevention (security) at the Wal Mart located near Palomar and Braodway?(by Costco) I might be contacting a lawyer due to inappropriate handling of my son and his friend both of who are minors. They were caught opening ipod cover packages(rude I admit) and were taken by security into the back and searched. I don't have any problem with that if they were looking for stolen merchandise, but the security told the boys they knew they had stolen nothing. What I'm upset with is the abuse my son and his friend went through. The boys were handcuffed so tightly that the cuffs broke the skin on my sons friend wrist. The security told my son he was bi polar and it was due to the fact that his mother was a hooker. One of the boys was also forcibly shoved down when he tried to stand up. These are not law enforcement officers. I have worked in retail management for years and loss prevention is not allowed to do any of these things. The police were called by Wal Mart and my son was charged with shop lifting even though no merchandise was found on his person and the cameras also found no evidence of them taking anything. This was 3 weeks ago and we have not heard from the DA so I'm assuming Wal Mart is not going to press charges. If anybody has a similar story with this same Wal Mart location I'd like to hear from you. PS. I'm not a hooker. lol I'm not sure what the laws are in California as far as Security Officers or Loss Prevention Officers go. I'm a registered Security Officer in the state of North Carolina and I have no arrest or detainment powers. A Security Officer's job is to observe and report, not protect and serve (that shit's for the cops). Depending on what California's laws state, you may be able to file a suit. A lawyer should be able to shed some light on the situation. If a lawyer won't take the case, chances are your son and his friend DID do something against the law. If they didn't do anything wrong and you can prove it, then you might have a suit against the police department for wrongful arrest. For everyone else in this forum talking shit about Loss Prevention or Security Officers... why don't you take a walk in their shoes before you go off talking shit about them. I deal with what I call "The Rejects of Society" every day at work. Anyone that deals with the general public knows what I'm talking about. But then what do I know.. I'm just a "rent-a-cop" -.-

Let me add to another one of your facts that I am reading if I did not misunderstand you stated the police charged him with retail theft then you said they didnt and its only been three months Ive had cases take 6 to 10 before going before araignment!!!!!!

You can bad mouth Loss Prevention all you want, But please gather your info before you toss insults around. I can tell you that I am a Loss Prevention officer for a big box company and i make 18.34 an hour..A far cry from your shallow insults.. Now for the matter at hand...It might sound like im biased towards Loss prevention but i am going to answer your thoughts with an open mind.
The biggest facts will be what your son was charged with. Is it possible the walmart LP made a bad stop? possibly..where were they detained? why were they handcuffed? If they were charged with retail theft then its more than likely the responding officer saw proof. Most if not all officers wont make an arrest unless there is physical evidence provided by the store. If they were not charged with retail theft than maybe the LP is trying to cover up a bad stop...Ive seen others do it...Usually i never use my cuffs unless I feel threatened or the shoplifter resists heavily. So the fact that handcuffs were used suggests some sort of altercation..Could the LP have used unreasonable force? possibly again ive seen rogue LP in my time abuse there power...
Also I have detained 1000's of teenagers in my time,I can tell you first hand they will lie..Not saying your son is lying just saying you need to understand children lie.
The fact that walmart hasnt procesuted does not mean its not going to court...There are many factors that are involved.. I get deferment requests on about 98% of my juvenile casses. The DA will contact me and ask me if i would be against deferment. Some cases the Da will drop etc..Has nothing to do with walmart..I dont actually work for walmart, but im pretty sure there paperwork is the same..Did your sone sign any walmart forms? If he did good luck in court your pretty much done...

Are Walmart LP in California allowed to physically detain anyone or physically hold them or use force to hold them? That seems to be the issue. The issue is NOT whether or not they had pot. In fact, if they had not been detained, they would not have been arrested for pot. So the real issue is whether or not there was a right to detain them. Because, technically, if they did not leave the store with any unpaid item, they did not steal anything. And I'm sure it's no surprise but I find open items at Walmart all the time. Open bags of socks, open bags of underwear, open open open. So, while it is inconvenient, if nothing is taken, it is not a theft. Lastly, I don't see a mom in denial and I don't see the need to attack her. She is in the right. If the police told her nothing was stolen and if the police told her they were arrested for weed then she has EVERY RIGHT ON THE PLANET EARTH to be angry and defend her child. That is a parental responsibility. She can address the pot issue as she sees fit but if her son was wrongfully detained by a Walmart rogue LP, she can take it to the bank that she has the right to be pissed OFF! Someone up here states they are a cop and an LP! Well, honestly, not much difference in my book. You are all "case setter uppers". It's your job. And cops do have a reputation for being block heads. Just sayin'. Reputations don't come out of the blue. There is a reason people feel that way, usually.

You guys are freaken funny ass people.. You guys don't have a life but to trash Walmart and their Loss Prevention... lol...CUM ON>>> IF you have a serious allegation against Walmart file a freaken law suite.. peak sake.. Look, I know trust me.. When LP for Walmart deals with a minor under the age of 16. They should call their parents after they bring them in and recover the merchandise. Even if they don't recover it and the subject dumps the merchandise on the way in. I am more than sure all those 300 cameras will catch some video. If and when the subjects become combative and resist. Then LP's can use less force..(read the penial code) it gives any retailer the right to prosecute and shoplifter regardless of age. The handcuffs are to be used - for everyone's safety.. If the LP has creative handwrititng then they shouldn't have anything to worry about.. Deter, Report, Recover and document the crime. That is the LP's job at walmart. GEEZ.. and last.. just in case.. you people don't know. Everytime a person shoplift's at Walmart, their prices goes up. And who suffers the consumers do!!!Take that to the bank.. DADIO... So next time, take your family and shop at TARGET.. I am sure Walmart won't miss your dum ass money..lol Happy Holidays.. and Good Hunting.. LP's..

I am a san diego law student.. and I have researched alot of cases against Walmart.. and of course LP.. they know their stuff. Their is a few bad apples in the bunch but most of them do their job well. The DA's or the City Attorney's have no problem dealing with them LP's. They are competely professional from my point of view and they win most of their cases.

JONA, no offense but your English grammar seems more like that of a 9th grader than a grad student studying law. Next time you want to impersonate a law student, you better take English 101 first. Too funny!
