Privacy Violation

My son was expelled for 3 days for fighting. During the campus level hearing, I was handed a packet of paperwork. After the hearing we left and upon returning home I went through the packet to see what was there. At which point I found the other child's medical record, at risk record, attendence sheet, classes & grade schedule, etc... and not my son's.

I called to inquire if my son's paperwork was also mishandled and they said they would have to investigate and get back to me. During my 2nd hearing at the Gateway campus, I brought it up and it was like a deer in the headlights look, followed by ... "we checked his folder and I would have to say no."

With that said, I would like to know if there's anything I can do to prevent this from happening again. If I had gotten a more concerned response and not something so non-chalant, it might not have upset me so bad. But we just punished my kid because he violated the code of conduct. What rights as a parent do I have to hold them accountable for their privacy violations?

It was a mistake and mismanagement of/with paperwork that you, a moral human being, are obligated to keep private. Plus, I'm sure, if you chose to use the information in some way you could be prosecuted - I'm assuming he's a minor.

Your son fighting on school grounds...well THAT should be taking more of your time and attention than an innocent mistake.

It is serious the mistake that was made. You need to file a complaint with the superintendent. Whatever your child did she/he is still a child and all children have rights of privacy. The adults need to be held accountable.

I agree with "yes", lol is full of shit. It's a mistake that shouldn't have happened, PERIOD. Innocent mistake, do you work for KISD? These people should be held accountable and the therefore punished for their mistake. And by the way they said they punished their son, so it did get their attention.

Thanks to everyone but LOL for your comments. I found a lot of good information in my research. At least I can say I have a better understanding of Family Education Rights & Privacy Act (FERPA) now.

I'm no "pussi". I'm no "ass munch". I also don't shift focus away from what's really important, here. The fact that the kid was involved in a physical altercation is MORE important than mishandling of paperwork. MOM is in DENIAL. And, yes... it could be a felony.

My friends, libel and defamation, wouldn't be too happy with the way you seem to he slandering this kid. It was never stated he was a felon and there's a fine line between free speech and what you're bordering.

I don't. I work in a field, however, where I have to provide a privacy statement to every consumer I meet. And I'm certain the laws aren't any different for children/students.

...Unless he was in an uncomfortable situation and threatened to be stabbed with a knife. Yet held accountable because 'he' had enough integrity to tell the truth.'He' admitted he could have handled it differently. He understood the 1strike policy. Point is, he understands the code of conduct. Violating it doesn't make him a felon no more than you saying I'm in denial.
...and I know this is going to upset you and probably free up a lot of your time. But let's face it. You and I aren't on the same page, to put it nicely. You're responses aren't worth dignifying with a reply. If there were a 'block' button, this is when I'd click it.

I have heard so many student complain about the principal in riviera abusing her authority and talking down to students with attitude and in a condescending tone. Parents have complained but sounds like nothing has changed. If this is the case, they should report her.
