Mayors reversal of home permit restores the Good Ole Boy network in Cheatham County
We have now become a target of a greedy landowner and a new mayor looking for examples to set and favors to repay. We purchased a small farm lot, went thru the legal steps to approve the building on the lot and have already placed a home on the lot. The week before we were to complete the services, the new mayor has revoked our building permit and forced a zoning appeals hearing based on the lies and complaints of a neighbor. We are told by the mayor that this rejection is due to a procedural error by the county and is not based on a falsfied complaint, and must be done to show the good ole boy network is gone. The 'procedural error' is the incorrect date of demolition of the structure on the property. To my understanding, we would have 2 years from the date of demolition to complete the building and occupy it. The permit was pulled exactly 2 years from the date of demolition (October 1st, 2008). We would have completed certification for occupancy a week ago if it were not for the obstacles put in front of us by Gary Lee. The mayor told us that this complaint has been around for a few weeks...but action on September 2nd would have allowed us to complete occupancy in time to meet the legal date because we would have known the legal deadline. Instead it was held until the permit could be revoked instead of revised. Something about this exact timing is very wrong.
The facts are that Gary Lee has been trying to condemn and seize this land for years and has found a new good ole boy to do his bidding. The mayor has picked a bad example to enforce his new zoning policies, as the property of Mr Gary Lee is no poster boy of compliance as it looks more like a residential dorm / industrial farming complex and junkyard rather that a rural family farm. And the mayor has chosen to ignore the false complaint that we have taken residence on the property without permits in order to grant Gary Lee his wish to condemn the property.
It is very easy to visit the properties involved and see where the real zoning concerns lie. It is also easy to interview the people involved and establish a pattern of harassment and obstruction that goes back for years. The crime here is the ongiong attempts of Mr. Gary Lee to gain possession of the land, and Mr. David McCullough has given him exactly what he was hoping for - a way to condemn the land and finish his master plan to seize it for cheap.This should have been investigated, and at a minimum the complaining property owner should have been cited for lying to public officials to file a false complaint. Instead the mayor decided to investigate the paperwork of the permits and found a procedural error that he used to retroactively revoke the permit.
We risk losing our investment and our future home after we have invested heavily in permits issued legally to us. And this retroactive political action does not serve the neighborhood or the community; it only serves the mayor and Mr. Lee. We should not be subjected to a hearing after the county (right or wrong) misled us into investing our future in this property. This will end up being a nasty public fight and great delay and expense for us and for our contractors to sue for our losses; and the county is liable when they revoke building permits that are issued erroneously by the county and at no fault of the landowner. This is wrong, it is political payback and favoritism, and it should not be happening.

And yes the county attorney was involved.
It was Bill Herbert that found the 'procedural error" and performed the dirty work for the mayor. It was Bill Herbert that dismissed the false complaint and ignored the lying to public officials by Gary Lee.
Someone is in collusion to try to condemn this land. The timing is just too perfect and made to cost us as much money as possible.
If this attorney is as sorry as the post on the Tennessean says it is, and he lies to the Board Of Zoning Appeals, we are in DEEP SHIT. We need help and from anyone that is willing to offer it to stop this crap from burying us.

Attorney Bill Herbert IV is the one who wheeled and dealed in Pegram filing unreasonable lawsuits over Town projects. The Town made up "rules" on the sewer for fees and rigged the system for certain builders. The Town used a consultant and bond company (Sentinel Trust) which had a long record of questionable dealings and was finally closed by the State. Herbert was hired because his Family has several hundred acres in Pegram along the South Harpeth and a private bridge over I-40. The Town lost the suit with Albamont and paid out legal fees and court costs. Now the Town has spent over $400,000 on legal fees with Trajan Carney, another old Cheatham name... lying is a way of life and some attorneys think they have a license to manipulate the law and facts to their own desire. Just be thankful that we still have Courts to review the few situations that are brought before them. And be Thankful that Herbert was not elected to Judicial Office.
