1 He has posted so much on the private lives of people and truth or not I do think their are laws against that. Personally there is so much gossip that abounds in small towns that it is just sad that people cannot get on with their lives after making a mistake. I don't care to read trash. I do like people's opinions and sometimes I learn from those opinions; other times I may disagree however I do try not to belittle folks for their opinions. Not everyone wants their dirty laundry to keep being exposed and no one is without a skeleton or two in their closet. Would would Jesus do? |

The United States was founded on anonymous discourse (which was mostly pamphleteering at the time) otherwise those in power would know exactly who to intimidate, belittle, denigrate, or harass in order to muzzle the communication of ideas and opinion.
The importance of anonymous speech is defined in various Supreme Court decisions: McIntyre v. Ohio Elections Commission, Buckley v. American Constitutional Law Foundation, Talley v. California, Lamont v. Postmaster General, and even ACLU of Georgia v. Miller. The loss of anonymity is the loss of freedom. I could give you a thousand examples where the lack of anonymity would stifle public discourse (the hardest hit would be victims who don't want to speak publicly due to stigmas, or whistleblowers who fear retribution). That being said, I do realize the harm that can be incurred to an individual's reputation, peace of mind and quality of life by those who post inaccurate, and often libellous, comments. We are blessed to be living in an age when we have a global communications network in which raving idiots can come together to give instant feedback in an unfettered and unmonitored online environment. What better way to take advantage of this incredible technology than to log onto the Internet and insult a complete stranger? The result is often an astonishing combination of ignorance, offensiveness, and sheer lunacy. BUT...to stifle anonymous discourse bears a far higher price tag for it results in fear-based "gag orders" which defy the very precepts of this country's First Amendment principles. For further background: Dendrite International v. Doe. The Dendrite line of cases gives an extra layer of protection to anonymous speech, requiring the court to balance the defendant's First Amendment right of anonymous speech against the strength of the prima facie case presented and the necessity for disclosure, even after the would-be plaintiff has made a legal and factual showing that his/her claim has merit. A perfect example of the importance and usefulness of anonymous posting can be found in the on-going St. Marys airport relocation debate on Topix. Much information (documented) has been disseminated in this way (an informed populace is a successful populace). Many of those who comment would risk the censure of the "powers that be" should they post under their own names. Are we to end the sharing of information due to the fear of reprisals? That thought is far more frightening than the realization that the odd commenter (or blogger) will say something derogatory or (to use a local blogger's favorite word) "scurrilous" about anyone. |

it will be a sad day. county workers are still under the "Berry silence law". that is that they can be fired for any reason, or no reason at all". they use the internet to blow the whistle or complain about working conditions. If I ever get on the commission again I intend to work toget that law repealed. |

Between the gag order, no raises, new higher fees for medical he has put himself exactly where he wants to be. The trouble with the elitists (that he is catering to) is that they can't abide gross behavior. Will they make an exception for him? Unlikely, however time will tell. This should be an interesting campaign. |
