you can't put something up asking for help and not telling the situation. you have to let people know who it is and whats going on or people will not even know if they can help. i can't find anything on your brother. is there something on the internet, a news story or something, that you can give us alink to? what is going on? the only way you're going to get help is by telling your story.

MISSOURI
Midwestern Innocence Project 6320 Brookside Plaza #1500 Kansas City, MO 64113 They advertise: Our immediate mission is to exonerate the innocent in prison by providing pro bono legal and investigative services to inmates with a substantial claim of innocence, but who cannot afford an attorney to navigate for them the post-conviction landscape. See if they will help-let me know |

First of all, before everyone jumps on this "he's innocent" bandwagon, consider a few things. Mr. Evans plead guilty to 2nd degree murder, armed criminal action and possession of a controlled substance back in 1994. Let me restate, he plead guilty. Mr. Evans plead guilty to pointing a unloaded shotgun at a friend, loading the shotgun and pointing it at the victim, asking her if it was "a good day to die" and then firing the gun upon her answer. Additionally, a writ of habeas corpus has already been reviewed and denied by a United States Magistrate Judge.
He's guilty, plead guilty, the conviction was upheld. End of story. Mr. Evans needs to serve his time, think about the victim and stop bogging down the legal system with his unjustified attempts at freedom. |

Read the crime detail and writ of habeas corpus for yourself. GUILTY ! |

doesn't sound to me like he had a good lawyer.
|

Sorry, but he could of had Johnny Cochran standing by his side and would still end up right where he is today. When you commit and then confess to shooting an unarmed girl in the chest with a shotgun, it's mighty hard to acquit. |

I couldn't get the link to open, but I have been at enough sentencings to know that there is a whole list of things which must be done at that time including allocution, ie. stating to the court that you are in fact guilty of the crime and that you committed the crime as charged. The appeals process is fully explained and the individual is questioned on the effectiveness of counsel with a list of specific questions. By entering a plea of "guilty", you are essentially waiving all rights of appeal absent exigent circumstances and even then there is a time limit. I have never seen a successful appeal of a sentence on a guilty plea. I am not familiar with this case, so I don't know if this person is "guilty", but if he appeared in open court and entered a plea of such, before the law he is. |

Thanks, looks pretty clear cut to me and that is pretty much the end of this case. |
