CONCERNED MOM

Morocco, IN

#1 Jun 30, 2012
My son was hit by a drunk driver leaving Misty's Bar approximately around 7:15 on June 29th. My son and witnesses identified the vehicle as a dark colored suburban that had been at the bar for quite awhile that day,and after they hit my son's car they sped off down route 34 east. Luckily my son and all his friends were not hurt.Anyone with info on who this person driving the suburban is please let us know.Thanks!!!!(My son is 17 and was just driving by the bar when it happened!)

Did you check with the bar? Someone might know who drives that kind of vehicle.
Drive around to the other low life bars and look for the suburban. JTs, sportys,and the rest.

Wow, first off, the vehicle was leaving a bar! Secondly, if the person driving the vehicle wasnt drunk, they probably would have stopped, to make sure the ppl in the other car were ok. So, im sure this concerned mother, isnt just assuming this person, who put her child in danger, was drunk. Really, its pretty much a dead give away.

If your aunt bartends at Misty's and lets people sit there all day and get drunk and get in their cars then she must be a real dumb ass. Not only that, she can be held just as responsible as the bar if they kill someone.
But then you can't get blood out of turnip and most of the women tending bar in those places don't have a pot to piss in or a window to throw it out of.

Lol, you ppl are absolutely ridiculous! I mean really. Get a grip on reality! Definitely not a crack baby! Haha. And my aunt and her husband have a hell of alot more than most of you tards on this site! And, if that person gets in their car and drives away after being at the bar for hours, thats their own decision and they have to deal with their consequences! Sure, she could call the cops on them when they pull out, but its not like shes getting everyones plates and checkin out their cars. She does have a job to do. And when shes at jt's she cant see outside, and she rarely is at misty's. So hows she suppose to see what kinda car they have if she cant see them. DUH!!!

It is really hard for a bartender sometimes to cut someone off. Maybe someone has been sitting at the stool for 5 hours and has had 6 drinks. A big guy may not be drunk. The bartenders responsibility is: not to serve someone to the point that they are "wasted". When you tend bar at a place like Mistys, Illini tap, JT's, etc. The guys who sit there for 5 hours, may be drunk, and maybe are not. Sometimes it is hard to tell.

DUH! you need to brush up on the law.
If she serves someone that is over the legal limit and they get into an accident. She can be held responsible just as much as the bar and can be sued or go to jail.
No one is expecting them to get license numbers, just cut them off when they have more to drink than they should.
DRAM SHOP

Cicero, IL

#22 Jul 3, 2012
Under Illinois' dram shop law, plaintiffs can recover after demonstrating that:

1.alcohol was sold to the patron by the defendant;
2.damages were sustained by the plaintiff;
3.the sale of alcohol was the proximate cause of the intoxication; and
4.intoxication was at least one cause of the plaintiff's damages.
Proximate cause includes the requirement that the dram shop must have been able to foresee that its actions could cause injuries to third parties, but this is true for any establishment that serves (sells) alcohol. One Illinois court allowed a lawsuit against a company that dropped off self-serve barrels of beer at a union picnic.
