What are the grounds on filing a slamder lawsuit? I was talking to a friend and they said they are being sued. They had put some stuff on topix and someone swore it was a lie, come to find out it wasn't a lie.I guess i am wondering if i am right telling them they should counter suit.Tell me if i'm wrong ,if it's the truth they have no grounds for the suit.Help me out if you know please.

I guess if they want to tie the courts up with childish, immature B/S, go for it. If they want to actually look like the grown up, have them stop talking trash on the internet and leave the court system alone.

When you sue someone for slander, they told me that they can counter sue that person if it's proven to be lies in the original law suit. They don't live around here anymore and they are saying they can counter sue and get alot of money.I guess i don't understand why someone would sue someone and lose and get sued in the process. My undersssssssstanding is if the truth is told, you have a possible lawsuit against that person.but,if you lose they can counter sue you.

My whole thing about slander is don't you have to prove who is talking about you? It's kind of hard if they are talking crapt on Topix about you to prove who is actually posting. So many people here in Kenton use other people's wireless internet because they can't afford internet. How can you actually prove who is talking sh$t about you? If this is what you are wasting my tax dollars on then get over yourself and move on. I rather my money go to convict a drug addict then defend a slander case. What is this world coming to here in Hardin County? Or as the ACLU calls it the twilight zone. So many peoples rights are violated by the judge's, Probation Officers, Police Department, and the Prosecutor that they will be investigating every case here in Hardin County.

i think that you can only sue for slander if you are a "public figure" and lies are being told on you it would of course have to be a lie and it would somehow have to be something that would ruin your credibility to being elected, re-elected, voted in or even voted out of some kind of political office or if you are a movie star, singer, rapper, preformer of some sorts... and if it effects your status in your employment if you are such a figure of the mentioned careers... pretty much its all legally relivent if you are someone of major importance and it would somehow be detrimental to your career, family life and/ or income of finances and of course if you have crediable witnesses to the alleged accusations.

Anyone can sue for slander! You people have internet, you can look up laws just as easily as you can get on Topix. Oh my! Educate yourself a bit before you post something stupid on here - just makes you look ignorant.

Actually Slander is defamation by oral utterance rather than by writing, you all would be talking about Libel and rather than try to compact it here is what it means :

libel
1) n. to publish in print (including pictures), writing or broadcast through radio, television or film, an untruth about another which will do harm to that person or his/her reputation, by tending to bring the target into ridicule, hatred, scorn or contempt of others. Libel is the written or broadcast form of defamation, distinguished from slander, which is oral defamation. It is a tort (civil wrong) making the person or entity (like a newspaper, magazine or political organization) open to a lawsuit for damages by the person who can prove the statement about him/her was a lie. Publication need only be to one person,*****but it must be a statement which claims to be fact and is not clearly identified as an opinion.***** While it is sometimes said that the person making the libelous statement must have been intentional and malicious, actually it need only be obvious that the statement would do harm and is untrue. Proof of malice, however, does allow a party defamed to sue for general damages for damage to reputation, while an inadvertent libel limits the damages to actual harm (such as loss of business) called special damages. Libel per se involves statements so vicious that malice is assumed and does not require a proof of intent to get an award of general damages. Libel against the reputation of a person who has died will allow surviving members of the family to bring an action for damages. Most states provide for a party defamed by a periodical to demand a published retraction. If the correction is made, then there is no right to file a lawsuit. Governmental bodies are supposedly immune to actions for libel on the basis that there could be no intent by a non-personal entity, and further, public records are exempt from claims of libel. However, there is at least one known case in which there was a financial settlement as well as a published correction when a state government newsletter incorrectly stated that a dentist had been disciplined for illegal conduct. The rules covering libel against a "public figure" (particularly a political or governmental person) are special, based on U.S. Supreme Court decisions. The key is that to uphold the right to express opinions or fair comment on public figures, the libel must be malicious to constitute grounds for a lawsuit for damages. Minor errors in reporting are not libel, such as saying Mrs. Jones was 55 when she was only 48, or getting an address or title incorrect. 2) v. to broadcast or publish a written defamatory statement.

So as long as ALL of your statements start with I think, you are good ~ regardless of whether or notits true.

I seriously doubt with the way the Judges have given some people a slap on the wrist that have been arrested many times are going to get re-elected. It's not slander because if it was they wouldn't be printing it in the paper. As for the Prosecutor's they are the ones offering the plea bargain to these drug addicts. So, now you really think that we as citizen's want to re-elect people that just continue to give a $50 fine and 3yrs probation? Again I ask you how is that slander. That is the truth. Public Record there.

good thing. hope you don't talk like that. that was the most boring thing i have read since highschool. you need to find a website that caters to people with intelligence. this site is nothing but a sh*t slinging contest. the more sh*t slung, the better. although i appreciate your insight, maybe you could just shorten it up a bit next time. and it's always more fun if you give people misinformation. that way you at least get a laugh out of the deal.HAVE A GREAT WEEKEND!!

Lol.... I was going for dry and boring there. Be here, JUST for you I will post it how I wanted to:

To the Original Poster:

Hey fuckin' moron...First of all it is called libel NOT slander (unless your computer talks to you, if so you have WAY bigger problems). Now that we have that out of the way, how about you shut the hell up, put your Big boy pants on, and attempt to be the bigger man. This isn't elementary school (for most of us...I am not quite sure about you though), a judge is not the teacher; when someone calls you names, GET OVER IT. Now...I think its snack time, go get your juice box and cookies and have a see on your cot.

Was that better?:-)
