"Castle Doctrine
Kentucky’s castle law authorizes the use of physical or deadly force when a person is confronted by a criminal attempting to commit a felony by use of force. The statute authorizes the use of force anywhere the victim has a right to be, inside or outside the home, and allows victims to “stand their ground,” not requiring a duty to retreat. The law does not protect victims from prosecution or civil lawsuit, however."
yes a "felony" which is anything stolen over $300 not 3 packs of horse meat i mean save u mor steaks...that would have been a misdemeanor...assault like the man recieved however could be a felony bc they were employees of a store, the man was not breaking in there house and trying to cause them harm
STEAK OUT

In my home steak is out , due to the cost . I see people with a stamp card though with steaks , candy for their kids etc . I have to say we can't do snacks this week because food is a priority . When you go to the store and food has increased from one week to another you pass up the steak and only wish . Maybe the guy got tired of wishing . I don't uphold stealing , just want to bring up the idea that we are getting ripped off daily by prices being gouged and no one goes to jail . I don't agree with STEALING in anyform .

food goes up anyways and i dont like a thief either i would get out and pick up cans to feed my babies to keep them from going hungry but i dont think a man should go to prison for 20 or 30 years for shoplifting either and have a bigger bond than a murderer would get .

Just like most uneducated Americans, most of the people on here can't understand the premise of this post.

NO ONE, that's zero people on here has said that the man had a right to shoplift. NO ONE is arguing that the store did not have a right to detain him.

The first post and the argument was over whether the store employees should have been allowed to beat him with a baseball bat after they had him down on the ground under their control.

People, the argument is not about "allowing" someone to shoplift. Don't you get it?

No use trying to argue with these self edumacated hillbillies. They know everything about all subjects. And if they don't know about it, they will call aunt granny over past the crick. She knows all about it.

I never shop sav u mor last time i was there i heard smirk comments from a cashier about a customer in front of me who was purchasing her groceries with foodstamps for her and her small children she had with her .I am sure the owner of sav u mor would not have approved of this employees comments if he had known about it I would think a lot of his trade comes from people who recieve foodstamps and that he appreciates having them for customers also or else he would not accept foodstamps.

The man should not have been stealing. Period. However, I seriously doubt he was stealing food unless he or maybe he has children that was hungry. Most pill heads steal things that have value so the items can be sold or traded for pills. Regardless, the man shouldn't be stealing anything but he should not have been beat by 3 store employees either. Yes, they had the right to detain him but not go gangster on him and beat him with a stick. Sounds to me like 3 rednecks who wanted their 5 seconds of fame. I had a well known KSP to tell me once that it is against the law for me to beat someone or shoot them if I caught them stealing out of my yard. The only way I was to touch them in self defense was to use equal force. For example, if a thief hit me with his fists, I couldn't use a ball bat on him or shoot him in self defense. In other words, you can't bring a gun to a knife fight. Those employess could have held him down, but unless he had a ball bat or a stick, they had no right to use one on him. He was for sure in the wrong for stealing, but for 3 people to beat him up, one using a stick, was definitely uncalled for. I would be ashamed to act in such a manner as those employees over a little bit of food. Detain him, sure, but beat him....ridiculous!

Yet Wyatt Earp did this and then became the most famous law officer ever. Just as hypocritical as all these people on here acting like they've never done anything wrong.
Yes the man should be punished but what he was taking wasn't personal. He wasn't breaking in their homes. Just think the stick was over the top. If two could hold the guy for a beating then three could hold him for the police.

Some moron said you could not shoot someone over a pound of bologna. I posted showing where DF is authorised. Protecting ones property is what Castle Doctrime applies.

When stealing, the property owner can administer DF because the SOB is stealing. You do not know if he is armed. You do not have to wait and find out under Castle Doctrine.

The lowlife thief with a pound of bologna in his hand gets shot. His side of the story won't be told. With the Castle Doctrine we are no longer required to retreat, warn or wait till they step inside.

If the man twisted his arm trying to break loose. He committed felony asssault while in the commission of a crime. If he tried to shoulder past them. If he failed to comply with the lawful instructions of the store owner. Did he make a threat?

The mistake they made was not splitting his brain housing group like a August melon.

Did you post the times you will be away from your home? You frikken moron.

I could take you more seriously if you knew how to use punctuation correctly. I've also recently taken the conceal carry class. You better read your castle doctrine very close before using a deadly weapon on someone. And a stick can be considered a deadly weapon.
