WAILUKU>> State Rep. Joe Bertram has argued a friend caught in an Internet predator sting should not be sent to prison for an "imaginary crime." Bertram spoke yesterday in support of Mark Marcantonio, 52, of Maui, who had pleaded no contest to second-degree electronic enticement of a child.

Imaginary crime? The guy showed up at the mall to have sex with a child! What's imaginary is Bertram's priorities. Someone should look in to his background and interview his family. Guess what they'll find. He'll end up on an episode of "To Catch A Predator" if they ever come here.

While we are baggin' on Bertram, what about the judge? NINE MONTHS! Are you kidding me? I suppose it doesn't matter, I heard that the Hawaii Paroling Authority reduced the 30 year consecutive sentence for the Salvation Army guy that ripped off old people to do a concurrent term where he might only do 3-5 years. I beleive he stated that he felt the judge was to harsh, even if this was the second time he had been convict of stealing from the elderly and vulnerable.

Enticement of a child is not an "imaginary" crime. It's on the books, Joe. Let's enforce our laws for a change. Stop imagining that your friend is an upright citizen.

For years I shook my head at Bertram's legislative record but just assumed that he was a political lackey or simply a coward who didn't have the guts to do what was right...

But now I just think he's plain stupid. What an idiot!!

Those of you in Kihei who re-elected him should be ashamed of yourselves and apologize to the residents of Maui and the rest of the State for the irresponsible manner in which you used your precious right to vote in 2008.

"He has been an upstanding member of the community," Bertram said. "He has been a good father."

Really??? So an upstanding member of the community and a good father does things like go online and meets 14-year-old girls and then meets them at the mall? Whether or not you agree that a crime occurred, the fact is that the intention of committing a crime occurred. It doesn't matter if the person was a 14-year-old girl or a police officer posing as a 14-year-old girl, did Marcantonio know that? No he didn't. I'm not going to say that our laws are perfect, but most of the time the law comes into action after a crime has committed. So...Bertram, does that mean you're willing to let an adult man or as you would say an "upstanding member of the community" commit a sexual crime against a minor and then and only then he deserves punishment? I don't know about you, but I'm not willing to sacrifice the innocence of a young child in order to finally hold someone accountable for the crime of sexual abuse. That's disgusting. Thank God there are police officers who are dedicated to posing as children online in order to catch these scumbags. Chances are that this scumbag has done this before and didn't get caught. Sexual assault is one of the most disgusting things in the world, especially against a child. I don't think there should be any tolerance for this. I think everyone should be working towards prevention of this heinous crime, especially someone who holds the power to create laws to do this.

"Joe, does this guy own you or what? What the heck are you defending him for, you two swap kiddie porn on the weekends?"
Willie, you nailed it!

Joe, did Marcantonio tell you he would implicate you if you didn't try to help? Otherwise, why in the world would you get involved especially after he pleaded guilty? Its not like its a political position and you testified at other court hearings.

YES- Imaginary-although repulsive there was no real crime commited. The "thought" police are the most dangereous!!!

How many times have you daydreamed of cheating on your partner or just wanting to punch out the idiot you work with. Ogling a girl or staring down a co-worker is not illegal. Up to that point it's only a thought, a fantasy unless you go through with it.

Just like these people who chat with others. There is no crime until something is commited. Just showing up is not a crime-yet. Up to that point it's still just a fantasy, dream or hope.

Careful how you respond to me or the "thought" police could be waiting for you too.

How could he have been an "upstanding" citizen and a "good" father if he is engaging in such deviant behavior.

I guess it's a good thing that Bertram is a politian and not a judge.

And for Mr. Disagree, there is a big difference between thinking of doing something and taking an overt step by going to meet what you thought was the 14 year old female with the intention of having sex with her. If you read the article you would also see that the guy already admitted to meeting a 15 year old girl for sex in the past. The nine month jail sentence is a joke. He has already proven he is and will always be a threat to children and should be locked up for life.

So... Bertram seems to think that his pedophile friend wouldn't have pursued such interests if he had not been enticed?
I could possibly see the argument if lascivious remarks were made over the internet and it went no further than that, but this creep actually got in a car and drove to get some of that action.
Way to commit political suicide, a-hole.

How is it only a though crime? He enticed the child! He wrote to the child on the internet! These are not thoughts, these are ACTIONS! He showed up at a mall to meet the child! How about the court make all of the conversations public. Then you would see how he purposely enticed the child through his ACTIONS.
If a person wants to think about having sex or beating up a co-worker or whomever, fine as long as it's a thought. They do something besides just thinking about it, then it becomes action. There is a huge difference between thinking an doing. Bottom line is that Marcantonio did something. He didn't just daydream about having sex with a minor he executed a plan in order to make his plan a reality. He wrote to the child and set up a meeting which he WENT to. It's disgusting that he got only 9 months in jail. It was no accident, he had a purpose and desire for an underage child. And he even mentions that he's done it before in his letters. I hope that others will come out tnad report that he had sex with them when they were underage and bust this pedophile.

This is one of the most asinine posts I have read thus far. It was NOT just a thought. The act of going online to hunt for a minor to have sex with is NOT just a thought. Enticing the minor to have sex with him is NOT just a thought. GOING to the mall to MEET with the person who he thought was a minor is NOT just a thought.

There is no excuse for defending such actions and you should be ashamed of yourself.

Bertram isn't from Maui. I mean he lives here now but he isn't from here orginally and like so many transplants they have no roots or common sense. Hopefully he will not be re-elected if we can find someone from here that will run in the Kihei-Wailea seat. This guy got elected on his bicycle path ideas and now is a big proponent of smoking weed and internet porn. Oh for the days when you had to live somewhere to get elected.

Or... next election you can "cast the lead ballot."

I feel sorry for the local Mauians. It must be hell living amongst the washed up seventies' rock stars and decaying hippies--Bertram's constituency, apparently.
