The case cracker; the end.

For the first time, Suzye Heartsong says the Tofu knife employed in the murder was on the table, not in the drawer. Since it was missing from the crime scene, only the killer could know this fact. Quoting Suzye, "I will deal with facts not unproven theories."

Case closed! Let's give the family peace.

A caveat: "only the killer could know this fact," or someone he told.

"To clear your knife theory, on the counter in the kitchen was.a salad bowl, chop sticks , vegetables, and cutting board out, it's in the police testimony, Tony had made a salad for lunch and used the tofu knife for cutting the vegetables up. No needed to find theo knife it was on the counter." Suzye Heartsong, July 6, 2002, Post 848, identifying herself as in the Bahamas and not Katy, TX as mistakenly listed by Tropix.

For Me it is obvious he did it; he had the motive and the opportunity, also he is so transparent in his demeanor, he lost his temper and killed her; unfortunatelly his sons and family are so willing to turn their sights to the other side so they wouldn't lose him too, is too sad that Toni did not get justice and another murder got away with it

Double jeopardy prevents BH from retrial. Just watched 48 hours on ID. Heartbreaking no matter how the trial ended. If guilty there is closure for law enforcement and some others and anguish for others. As it was, uncertainty for many, relief and closure for BH and a case that cries of a murderer getting off scott free. With no more evidence to get, no more suspects except the schizophrenic man who left the state and who was cleared as a suspect, unless he or someone else comes forth, this case is dead. Law enforcement gave up. Honestly BH did not seem like he was hiding anything and his immediate reaction when the verdict was announced was not that of a guilty person getting away with murder.(For examples of the guilty found not guilty just view the O.J and Casy Anthony verdicts.)

Let it go!!! I will do so when I press the 'post comment' button.!

I would like to say that I watched the 48 hours investigation & have read much of this blog due to my own curiosity & I have come to this conclusion. I do not believe that Bob Heartsong did this, I feel that he has been tried by a jury of his peers, the state was given a chance to conduct an investigation to try & prove his guilt & they did not. Toni is dead, her sons have their father so they have not lost both of their parents. Leave it at that & MOVE ON. Bob Sherin you are a fanatic & quite frankly obsessed. My advice, seek couseling.

I personally do not think BobS is a fanatic. Passionate about this case, yes, but just because someone is writing a book and open to talking about a mystery murder doesn't mean they need therapy. In fact if I were murdered or someone I know was and no one had to pay for what they did I would hope someone should be intrigued enough to write a book about the facts that happened. As for the jury that found him innocent, many of the jurors agreed, or so I understand, only put in a not guilty verdict is because they had inconclusive evidence. Most believed he was guilty but can't reach a verdict off of feelings.

Bob S.

I'm actually disappointed you will never release your book because I would really like to read the facts of the case. However, I do understand how that could be hard for Toni's family. I do wish them the best.

I loved how you said him knowing meditation helped him pass the lie detector test, and also pointed out the flashes of anger we saw after his victory, because I thought the exact same things when I just watched the episode on investigation discovery. The look he had in his eyes outside of the court room definetly made me think he really could have anger issues and that there is probably a whole other side to him. I do think the tofu knife is strange. Now did the stab wounds imply that that was the type of weapon that could have been used, or were they just making it out to be because it was missing? I also agree that how she was killed most likely was personal. I can't see anyone getting so angry at a complete stranger and beating them so brutally. However, I still am curious about the unidentified finger print, foot print, and hairs. I'm hoping you might be able to shed a little light on that, maybe you have more details on that than what was showed in the episode I saw. And at the end of the show it said the case was now closed. Did they convict someone? If not I thought it would be considered a cold case not a closed one.

Last but not least my condolences go out to Toni's family. I hope time has brought some sort of peace to you all, and if the case really is solved I'm so happy you can have closure and Toni has gotten her justice.

J Heyen,
Appreciate your kind words. The finger print on the deadbolt was never identified nor were the hairs, including the red beard hair in her pubic hair. One explanation: Toni had shopped at Burdines that morning, supporting the theory, she picked up hairs while trying on clothes.

Another side of this case never brought out at trial. At the gym where the Heartsongs worked out, Toni had made friends with a young, retired, police officer from New York City. Bob made mention that she could bench press around 140 pounds. Bob too was into weight lifting, because pushing himself too far, he had pulled his right shoulder socket and was due for repair within the week.

Jupiter to Delray has turned out, epicenter of international pill mills. Government operations in the past few years, such as Operation Which Doctor, have taken have down the industry, which started in 2000 shortly before Toni’s death. Gyms were the first distribution points. Kingpin of steroid sales, retired, New York cop, Anthony Forgione, now busted, is serving prison time. In his thirties in 2000, Forgione cut a hyper-masculine image and adulation, especially in contests. Did steroids play a part in Toni’s murder? Did Bob push himself into injury out of feelings of insecurity? Was jealousy a factor in the murder?

This, admittedly, is but conjecture without proof. Watching Bob on 48 Hours last night, I kept freeze framing for signs of steroid use. His shoulders appeared developed yet what I saw didn’t prove anything.

Something smashing, however, did emerge from yesterday’s viewing: At around 34 minutes into 48-Hours, Bob talks about the Tofu knife ordinarily stored in the drawer, as he maintained it was that day. He contradicts his wife Suzye, who revealed above, the knife was on the counter. The Tofu knife is important, because it’s the presumed murder weapon. After battering Toni’s head on the concrete breezeway, the killer retrieved the knife to finish the job. With an apparent knowledge of anatomy, he stabbed her in the neck so she’d bleed out.

Two versions: At trial and on 48-Hours the Tofu knife was in the drawer, with Bob's corroboration, while just above in this thread, according to Wife Suzye, the Tofu knife, the one piece removed from the crime scene, was on the counter. How would Suzye know a fact to which only the killer would be privy?

In an attempt at cover-up, did they float this fact, little realizing the admission against interest it carried?“I will deal with facts not unproven theories." Suzye Heartsong, May 3, 2011, Post #790.

Off-thread, Tofu knives with rounded tips was raised. Research unearthed different configurations with pointed Tofu knives being usual. This wasn’t an issue at trial or in this thread. To everyone material, the Tofu knife missing from the crime scene was the final weapon presumed to be in the drawer beneath the counter while on it stood visible knives bristling from a butcher block. This thread started on November 17, 2006. Above, on July 9, 2012, for the first time, Suzye Heartsong informs us that the Tofu knife portrayed by both sides at trial as in the drawer was on the counter, a fact only the killer would know. A Friend, You'd have credibility if you gave us your real name. Instead Suzye denies your posts come from her camp, but how else would you be privy to the information you post?
In any event, let's take your charges one at a time. The book was no mistake; it has had quite an impact on Florida justice. First of all, the error on Bob was minimal and harmless. But when you're going to press with a hot product and have friends you trust, who raise Bob's predicament at dinner, anyone with a sense of justice would want to pursue it. And I did pursue it for Bob's benefit. I found out all about the grab bag of grants authorities were running after for cold case cash using advancing DNA technology.
Coverage of Bob wasn't intended as any help to me. I did so to help him. At the time, Bob was in Palm Beach County jail incommunicado. When Suzye read it, she didn't complain, in fact she viewed it positively. It was only after I reached the conclusion that Bob had culpability in the crime -- for which he was found not guilty, after had stepped down, the campaign to discredit began. And it began in the face of my vow of silence.
So here you want to have it both ways. When I'm in your corner, the error was harmless and everyone is happy with my gratuitous contributions: Domain, Web design and freelance writing. Even Bob embraced the book and the help, albeit with Paul's amoral hype about Viet Nam and heroism.
During this whole period, whenever Suzye wrote, I paid attention. Whenever an error was pointed out, I corrected my copy. Nonetheless Paul remained mute while you guys ran a smear campaign. And if you going to comment on "Justice Disrobed," don't you think you should read it?
Now let's get to the case. I studied the 122-page police report in detail. I ran a time line on every person in the report, which showed vast discrepancies. I did not read the discovery, because the ultimate trier isn't the discovery but the trial. I sat there for every moment of the trial, taking voluminous notes and even recording it. If you were there, you would have seen how the lawyers raised the discovery when trial testimony varied. And that is the purpose of discovery. I watched the whole movie and put together all the facts, a case that was never presented to the jury. Still, I don't begrudge the "not guilty" verdict. Based on the State's case, I think the jury got it right.
Trouble was, the State's case consisted of generalities. That is all the jury, knew. They judged from the four corners of the case. Having interviewed people after the trial, having run my scenarios by other astute spectators, viewing Bob's Jupiter home, talking with his neighbors, putting facts together, such as Bob's drive a week before when he said to himself he should be dead, and the wobbling presence of the BMW, I have drawn many unassailable, well reasoned inferences that were not expressed to the jury.
You know, a Friend, you are motivating me to write the book, because there is so very much that never surfaced. I know I can write with proper caveats and in proper bounds. In the coming week, I'll make that decision, and if it is positive, it will be a blockbuster that will make no money. But maybe, in the interest of truth, that is what we need.
"Coverage of Bob wasn't intended as any help to me. I did so to help him." Oh. Please. You've plugged your book in every crevice of every post that you can. You've made countless errors, yes- overcompensating with excuses and apologies when called out, but just after ONE you've discredited yourself.#nolongerinterested #wasentertainingwhileitlasted #youseemalildouchy #jumpofftheopportunisttrain

Gang, let's stay on track, because there's so very much to remember.

First, permit me to address motive: I printed and sold only 200 copies of my first book, called “Justice Disrobed.” Bob became a part of it as I championed his cause based upon misinformation from friends. It's now out of print. As an author, I've assured the Heartsongs of my present intention not to pursue this murder with a book. I'd like to give the family peace, but it will only come when the Heartsongs stop orchestrating their smear campaign here. I'm not the murderer. Isn't one murder enough?

Now to the unforgettable case cracker from previous posts in this thread.

“One by one I will answer all your questions and prove to you how wrong Bob Sherin is. He will argue against me, and that's fine, but I can prove everything I write. I will deal with facts not unproven theories.” Suzye Goldstein-Heartsong, Post 790, May 3, 2011.

the bottom line is the palm Beach County aplied for 13 million dollar grant for Cold Case Deptment, but they need to prosacute a case, the only good case with a bad investigate and a husband to blame it all on was Robert Heartsong. We meaning Bob and I made a few mistakes, one we hired a lawyer, with out doing any investigaton, we took the first one we met, we were too dumb to know better. Robert should have gotten a lawyer the first time he was brought down to the police department, even if your innocent, don't think that matters, it's nothing like t.v. The truth is not important. In almost the two years Bob spent in jail, one of our lawyers only visited him once and the other one maybe 4 times. I spoke with them many times and kept asking why they weren't asking certain questions, thier reply, long as we win, that's what counts. That is not true, you need to win with the whole truth, it wasn't that all the witnesses lied and some did,(to be honest they couldn't remember 8 years prior, could you or anyone).
Robert and I lost everything we owned, we are no longer together which was just the stress of this whole ordeal. I don't regrett for a moment that I stood by him, I didn't do it because I was his wife, I did it because I KNEW he didn't do it, and we must stand behind our beliefs. It was the worst thing I ever had to go through, and I have had some really bad things happen in my life. This was not my first marriage, it would have been so much easier to run from this. I didn't because sometimes we have to stand and fight for right. And this was my time.
One by one I will answer all your questions and prove to you how wrong Bob Sherin is. He will argue agaist me, and that's fine, but I can prove everything I write. I will deal with facts not unproven theories.
Right now I'm tired, but I will continue with this in the morning.
. Hey consider yourself lucky you got out; there's every chance you would have been his next victim. Seems everyone but you knows he is guilty as sin. A soulless, evil man.
