Why would this judge sentence someone to probation for permanently disabling a man, and then in the same week sentence another man guilty of looking at child pornography to 3 years in prison. Seriously, think about that. I am not advocating child porn, it is wrong. But, I do think the sentencing theories for "victimless" crimes are way off sometimes.

A few things,

1. This sentence was okay with me. It was a fight, and both parties had words, or it would seem.

2. Joe isn't a monster, and didn't mean to out him in a coma. I have seen 25 or so fights were the winning parties raised their hands in victory after a fight. I saw it in HS, saw it in college, and after college in bars or parties.

3. Joe isn't a saint but neither was Eric. I feel terrible that he is the way he is, but he started plenty of fights in his tenure too. Anyone who visited Bluestone in its heyday would tell you so.

4. Joe will never be a teacher, like he wanted and with a felony on his record his life will nt be all peaches and cream.

5. I have kids and and if one of my sons had this happen to them,I would be destroyed. But unless he was just caught out of left field with no way of knowing he was in a fight I wouldn't want the other party to be in jail for 10 years. Just me. My sons are raised to know that if they get involved in something like this, that anything can happen, so think before you speak or talk garbage. Because words are threats and violence can follow.

And LW I did ask a lawyer. While they could after him for murder down the oaf, he thinks that it is very unlikely they would. It would be a PR monster, and after 20 years or maybe fewer it would tons of tax dollars. Especially for a non murder one case. But hey It could happen.

Have any of you ever been around JOE when he has a few drinks in him? He is a complete idiot and his behavior to say the least is a MEAN drunk. Do you think during his trial he stopped drinking? NO. Drinking with his buddies and dad while ERIC is laying in a wheelchair, unable to care for himself. Thank you to the judge for holding an ignorant jerk who loves dogs accountable for his drunk actions.

I agree with you Steve! Sounds like your pretty into the facts of the case~It's a sad situation and a very disappointing outcome! Even the Chief was disappointed! I really feel for the victim and so does everyone else in Will County! God Bless him and his family!

2 guys fight and nobody is seriously hurt - everything is fine and dandy.
2 guys fight and one of them is seriously hurt - the guy who wasn't hurt is charged with a felony.

Moral - If you must fight, don't win...

How about we look at some facts. The testimony from independent witnesses stated that after the Mr Bartels was on the ground and defenseless. Mr Messina straddled him and punched him again. It was at that point that Mr Messina raised his arms in the victory posture. That is where this became more than just a bar fight, it became a brutal attack. Its all in the trial transcripts for all to read. I dont know how anyone can justify these actions. I guess its due to this ultimate fighting garbage. Where they attack when someone goes down. In the sport of boxing when someone is knocked down a fighter goes to his corner. If the downed fighter gets back up and is okay to fight the fight is resumed. But attacking someone who is already down and defenseless is a classless move.

Frankie, I'm not sure if you have kids or not, but if you had a son, what would bother you more? Your son getting caught up in a fight that went bad one night or finding out he's a pervert and likes little kids, I'm not sure how you consider child porn "victimless", that is just a dumb comment!

As I said before, child porn is wrong and I'm not advocating it or trying to diminish its seriousness. Although, I do think there is a big difference between actually participating in or orchestrating the actual pornography and viewing it on a computer. I just don't understand the drastic difference in sentencing. Look, I don't care if this fight started out as mutual combat. In the end someone took a defenseless blow that caused permanent disability. Shouldn't he at least get a year? Something? 30 months probation is pretty rediculous and every impartial person knows it. If you're associated in any way with the offender, ofcourse you feel differently and I can understand that. Maybe the mandatory minimums are different for the two crimes I am discussing. I don't know. But in the end, use some common sense and think about it.

Really so when you are stretched out on the ground and unable to defend yourself its okay for someone to climb on and punch you in the face again and drive your skull into the pavement. You call that fighting. I call it being a little bitch.

Funny all the defenders of this guy say he did not throw the first punch that knocked the guy down, his buddy did. But nobody is disputing that he climbed on top of a man down and punched him again. Multiple independent witnesses saw this and identified him as the guy who hit a downed man and then raised his arms in victory. Pretty sad.

I personally think the guy who punched first was probably thinking preemptive strike is his only chance at winning!
I also believe the person who punched the guy out was probably showing off his brute strength. Knowingly hitting him with everything he had. Never pondered the consequences! Dude is guilty in my eyes. Anyhow I don't believe anybody should get any time in jail. Who benefits if that happens? The private firm paid to house and feed these people! I'd sue the shit out of him.

The court ruling on this case is just wrong. However what I find even more disturbing is that Joe is doing his community service hours at New Lenox Mustang football games cooking on the grill, laughing and having a good old time!!! Really what idiot from the Mustang organization though it would be a good idea to have a convicted felon around children. This man should be doing his community service helping paralyzed individuals, so he can see first hand on a daily basis what he did to someone. Im sure Eric would give anything to go cook on grill, watch, and have a good time at his childs sporting event, but thanks to Joe it will NEVER happen. MUSTANG PARENTS or ANY PARENTS FOR THAT MATTER DONT WANT HIM AROUND OUR CHILDREN!!!!

No one should ever hit someone that is already on the ground. The intent is to do more than win the fight when you hit someone like that. Intent should have been considered in this case.

Being a little bitch is talking shit to someone and not being able to back it. Also being a little bitch is putting yourself in a situation to get into a fight knowing you might not be able to come home to your kid afterwards. Also being a little bitch is getting your ass beat in a fight you caused and then blaming someone else as if you had no part of starting the fight. Plain and simple dont talk shit unless you can dance to back your big mouth.
