My wife and mother of our 6 children walked out on us Oct. of 2005. She has hardly visited the kids and has never gave me any kind of support for them. After a while I met someone else and we moved on with our lives,in the meantime she has failed a drug test and had her probation revoked. In May of 2006 I filed for divorce. July 18,06 she barged in My girlfriend's house where my children and I live, Her brother and his wife followed her in. In a split second she lunged for my girlfriend and I grabbed her and forced them out of the house. While I was standing on the front step, her brother picked up a flower pot a threw it at me , striking me in the face. I stumbled and fell into the yard, that's when the three of them started attacking me, she kicked me in the mouth knocking out my front tooth. I was able to get to my feet and they ran for their car. The police finally showed up. While the police were talking to them I went into the house to calm the kids and clean the blood from my face. When the police came in they said I was under arrest for domestic battery, When I tried to tell what happened they told me to shut up or they was going to add obstructing. so anyway as they were taking me to jail they let her take the kids. the next day when I bonded out, my girl friend went to talk to the States Attorney and she told my girlfriend that if her kids were in the house that she would barge in to. After I bonded out I received a protection order and went to get my kids back.I finally received my divorce ( she never has shown up for any court)I have full custody, she has no visitaion. I just don't believe this law was intended this way I should be able to protect my home from anyone. But this States Attorney is trying for jail time and the lawyer fee and my bond and dental bills are topping 3,000 dollars. I live in Clay County, Illinois. Any opinions?

Get a good attorney. Maybe go to Effingham to get one.

I used to work for a law firm in Effingham; Marilyn Resch at Siemer Austin would be a good pick, and also Lou Viverito at Taylor is a good one. I'm sure by now you have probably already gotten representation, but I wish you the best nonetheless.
