It takes on average 4-6 months for blood to come back from the TBI. be patient.

All they have to do is supeona the records of the night they were admitted into the Hospital. Blood was taken then. They know this but it's election time and they would rather wait.

I wish that it worked that way. It takes weeks sometimes up to six months to get blood results back from the TBI. A lot of people seem to think that a person can subpoena medical records and use the records in court. You can use the medical records if it is not challenged by the defense. If challenged the medical records are thrown out. Yes the records are thrown out because in a court of law there has to be a documented chain of custody for the tested blood. This includes the date, time and every person that handled the blood. This can include up to ten people at the Johnson City Medical Center alone. If the courts allowed the medical records in every single person that was present for the blood draw and all who was in the chain of custody would be subpoened. With the amount of DUI prosecutions and the fact that a DUI trial will take approximately 5 court appearances before conclusion it would wreak havoc on the employees at the medical center. The fact is it takes time to get the blood back. There is only one evidence processing center and these hard working people process all the evidence in the entire state. They have to prioritize the evidence as it comes in. The most serious cases come first. If you would like to see THP use the medical records for prosecution the charges would be dismissed. With double jeopardy considered you only have one shot. Why not do it right the first time.

Drug testing takes what 3 days at most so this is serious folks the county could spend a extra 10 bucks and have it tested in a third party testing lab so we know what going on sure it may have been drugs not alcohol but we shouldn't have to wait and see . A example for the other officers needs to be made .

First of all a chain of custody has to be established. Remember dates, times and all the people that were present will be subpoened. The state processing center is where all the blood draws for the entire state goes for examination. Their stringent policies have withstood hundreds of court challenges. These people are the best of the best. The courts would not allow a private examination of the blood. This is not a simple hiring process with someone going through a drug test. This is trying to prove guilt beyond a reasonable doubt.
