I wouldn't call it an injustice as they were convicted of felony reckless endangerment. The circumstances seem to indicate they were fleeing and had been involved in some type of serious crime.
Now it's up to the judge to decide if the state maximum sentence applies. I think it does. If he goes soft that would be the an injustice.
Clark knew they probably were swerving to evade the spikes but that was a matter for the jury. To demonstrate support for the deputy struck he tried to get the maxuimum charge/sentence. Can't fault him for that though there's a couple of idiots online saying he messed up.
