I cant believe the sorry job Clark did in prosecuting these three who ran over one of our counties finest while fleeing from Deputies in a pursuit after committing armed robbery. Clark could only convict them of reckless endangerment a class e (lowest grade of a felony) write a bad check for a dollar type charge. This is ridiculous the Public Defenders made him look like a high school mock trial participant. Even the Judge threw out charges on his own. Our law enforcement puts there life on the line everyday and are represented by such a farse. I think the State should appeal to a higher court for Justice this sends a message to every thug who wants to flee law enforcement and run them down that there is little consequences to it.

not attempted murder

If you actually watched the video, it is clear the driver was aiming away from the officer. The officer instinctively moved back into the car's path. Such an act on the driver's part is "recklessness," not "intent and premediation to kill."

The jury pretty much got this right. At least Clark thought enough of the officer to give it a try and not just plea bargain the matter.

How could this not be attempted first degree murder and yes i have watch the video why didn't the Prosecutors bring in an experienced Prosecutor to handle such an important case, all Attorneys in our area will tell you that Tony Clark is the worst Attorney in his office.

1. Baldwin worked the trial; he has more experience as a prosecutor than anyone in the district.

2. Name one attorney who would say that Clark is the worst attorney in his office. Name one. You can't, because that's a false statement.

3. It's not attempted murder if the driver wasn't intending to hit the officer. His intent was to avoid the spike strips AND the officer by going left. He was trying to get away. Had he aimed the car squarely at the officer, that's a different story.

Why then did Tony Clark charge them with attempted murder? Why was Tony Clark the one on the news questioning the defedants and making his stupid closing remarks. Go to WJHLTV11 web site watch the story titled "Three defendants acquitted on attempted first degree murder charges". I agree Clark is the worst attorney in his office all you have to do is ask any attorney in this district and they will tell you the same.

I really am curious about something...
I know that Baldwin prosecuted the case
(& did a good job at it) so why did Clarke handle the closing arguments?
There is no sarcasm or disrespect intended , I think everyone done the best job they could.
I just wonder why Baldwin didn't finish it up.

Good point .... Anyone know the answer to that one? Y did Big Tony swoop in at the end? Was he trying to take the credit for all of Baldwins hard work or did he just not have enuf faith that Ken could pull it off?

The sheriff's office put too much pressure on Clark's office to prosecute attempted 1st degree... The jury got it right, all 12 of them, so please, stop with the tony Clark stuff, you dimwitted idiots. It was never an attempted murder case, the sheriff's office should stop over-charging their crimes when one of their own is involved. You just got the same result for the same reason in carter county.

WELL SHUT UP ALREADY, the sheriffs dept. over charges the sheriffs dept. cannot charge with anything the charges come from the attorney general it is a shame he lost this case, and i read in johnson city press on line that he lost another charge in Carter Co. on attempted murder and several other charges thrown out by the Judge during the trial even his asst d.a. in carter county said they had no probable cause? why charge and arrest someone if you have no probable cause and how do the indict through the grand jury with no probable cause, sounds like perjury to me.

The DA should never allow law enforcement to pressure him into indicting anyone with a crime that he does not feel he can legally prove. Although he probably charged attempted first degree murder in support of the officer but does he give the same support of other victims that are not law enforcement?

Y didn't ken Baldwin present the closing arguments at the trial? I don't think it would've had any impact on the outcome but I am curious about the motives. Y did Ole Tony take over at the very end? Was it a trust issue or was he just (once again) trying to take credit 4 someone else's hard work? I feel bad for Baldwin .. He handed this one over on a platter .. all the work he put in is now just another of "Tonys Trials"

I completely agree, he shouldn't..but that's the political realities.

As to whether or not they would've done this with a non-law enforcement officer can't be answered in this case because a citizen wouldn't be employing spike strips. Well, not yet at least.

I'm not sure whether u'r uninformed, naive, or a water bucket carrier for law enforcement, but if the sheriff says they are going to the grand jury on attempted murder, the d.a.draws up the paperwork for that charge. Sure, they have the discretion not to, but the sheriff carries tremendous political weight. Then it's "left up to the jury" to make the right decision.

As to "probable cause"..pleeeeeeze. Really?

You are a dumdass or this is Kent Harris, I have worked with and around Clark for years, why don't you ask the WCSD about how Clark did, one of the best cross examinations of defendants I have ever seen, closing was fantastic, and as far as experience Ken Baldwin tried case with Clark and he has tried hundreds of cases. You are one of those pathetic idiots, who blabs on about issues that are far above you're intelligence level. Check the court records and see how many serious cases Clark and his staff have tried and won. Remember Willis, 8 year old case Clark took office and had it to trial within a year, and now he's on death row. Multiple murder convictions, rape, robbery, drug convictions, yea, pretty sorry lawyer!!!

For the record , Clark did not charge them, it was charges brought by WCSD. Only attorneys you will get to bad mouth Clark are most likely the ones he has beat on cases, worse attorney in office, what has he done convicted you or a family member? IDIOT

For the record dumb ass , Clark participated in picking jury, questioning witnesses on both sides and he and ken both did a closing argument, and what other work has Clark took credit for that he did not do? Go crawl back under your rock and smoke some more crack
