Tom Simon put a despicable full-page ad in the Star Beacon on Sunday. I use that word - despicable - because there is no more accurate one. Simon is using the tragic death of a young man in a shooting at his former bar, the LA Cafe, for two reasons: one is to get back in the Solicitor's Office. The other is to divert attention from the fact that this shooting is his legacy. He opened the LA Cafe and ran it for years. It, along with the Dry Dock which he also ran until the court through him out for stiffing the prior owner on the purchase price he agreed to pay, were characterized as "drug bars" after a year-long FBI probe. He created the image of Bridge Street as a place drug dealers went to do business. And while Tom was in office, no one bothered them. As far as his specific allegations go, Earnest Dyer did not have a felony record when I checked it in June. He was at that time only 19 years old. He pled guilty to Possession of Drugs and Carrying a Concealed weapon - 1st degree misdemeanors punishable by up to 6 months in jail - and Discharging a Firearm in the City, a 4th degree misdemeanor. In July he was sentenced to 6 months in jail (Simon left that little fact out of his timeline in his ad, because it would have demonstrated the falsity of his claims). The Municipal Court, in its sentencing entry, which I will post for everyone to see, found that, due to jail overcrowding, no space was available, and he was given a future jail report date. In short, I did everything I could to punish the conduct of which he was guilty and to get him off the streets several mkonths before this tragic shooting. Circumstances beyond my control prevented that. Contrast that situation with the case of Ronnie Milam, who in December of 2007 bashed his father's head in with a hammer over money he wanted for drugs. Milam had previously been through the Municipal Court numerous times on Simon's watch, yet he did little if any time in jail. Simon had dismissed a Concealed Weapons charge against Milam and bound over a couple of drug charges that were "no billed" by the grand jury. Had Simon worked the system properly, Milam could have done some jail time on those drug charges, but Simon clearly didn't care - then. Now he has an election on his hand, and pretends to care. He cares so much that he is meddling with the ongoing investigation. I have had complaints from members of the Derricoate family that he is calling them and pumping them for information. This politically and personally motivated exploitation of others is a Simon hallmark. Ashtabula, it is up to you to decide if you really want to give this man power again. I only ask that you know him for what he is when you cast your vote.

Crystal Kirk sent me this email. I asked her to please post it, which she did on my personal Facebook Page. It needs to be read by anyone who thinks he or she knows Tom Simon: I don't know why but I feel compelled to tell some of the things you didn't read about in the papers.... Here's my story My mother passed away when i was 19 years old. She left the Dry dock to be sold. She also left me a very large sum of money. Simon approached me and said I should try to buy the business from the estate.I used my inheritance to purchase the bar. He represented me in doing so. Once the court battle with my family was over, I was the proud owner of a business I was too young to work at. He of course, offered to take it off my hands. He drew up the contract himself and never advised me to seek my own attorney. I didn't know any better then so I signed it. Years go by without any money changing hands. I decided to sue him. Lots of thing happened during that time. A few of my personal favorites include, losing my job due to an "annonymous" phone call to my employer. I was pulled over 3 times in one week by the Ashtabula police dept. When I went to court Tom said he could make all my tickets disappear if I dropped the lawsuit against him. I did not and ended up with a suspended license. During the time the suit was going on he managed to get 12 violations on the liquor license, which was still in my name and never paid any taxes. When he was finally evicted from the property, I had nothing left except the building which I sold for next to nothing. I did eventually beat him in court but of course never received a dime of compensation. I'm sure I never will. I just felt like sharing that with you....

i HAVE ONE QUESTION FOR YOU GUEST, dO YOU REALLY THINK FRANKLIN IS ANY BETTER? Look I have lived in Ashtabula for over 40 years. I went to LA Cafe when Tom and Joanne first opened the bar. It was a nice place to go. The Dry Dock used to be a nice place to go. I was friends with Linda. She didn't want her daughter to run that bar and I would never have gone against what my mother and family wanted. So why cry about it. What it boils down to she was too young to make decisions. Getting back to Tom Simon, if you believe every little thing you hear thats your problem. I personally know Tom and he isn't the rotten person that people try and make him out to be. Nobody is perfect but I for one would never have voted Franklin into office. He needs to watch out because next election I believe Tom Simon will Be city solicitor.
Now I have one more thing to say to People for Franklin: HOW DARE YOU EVEN BRING UP RON MILAMS NAME. I AM A RELATIVE OF HIS AND YOU DON'T KNOW EVERYTHING. Again you cannot blame Tom Simon. Whats the excuse for all the other drug addicts and thieves that get off now? Is that Toms fault? Our city is a joke. Everyone laughs and says if you want to get away with doing drugs or committing crimes just live in Ashtabula. Sometimes its better to be silent then to talk about people you nothing about. Our police force is weak and our solicitor isn't any better.

It has never been made known to the public YET but I blame TOM SIMON for hurting my family also and letting and getting people off the hook that was responsible for a very HORRIBLE ACT against my family, my child and humanity. It will NEVER be forgiven against those pieces of shit trash that hurt my family. Not ONE FCKIN day goes by that I do not want to shoot them each about fifty fuckin times. I should be given a gd medal for not confrontingh those basterds on a street level. YES I ran in a bad ass circle when I came up and my nature is too handle it on the streets not the courts. I went and presented the case to Tom and he failed to prosecute. He also cost me $40 Thousand fucin dollars. I want those mF heads cut off for what they did. All I have to do is make one fckin call to Chicago and my "friends" from the getto will handle it. Years don't make a differance to someone like me. Only revenge matters. Now it is a matter of dis my "family". Let us cross up.

Tom Simon and his family are a bunch of losers. He let those bars raise his kids. Out of the three he had, only Greg came out ok. His other son is a raging alcoholic and prolific drug user. His daughter, the same. Except she lost her child because of drug addiction. He has been foreclosed on countless times, and got his son in law off of a 30-40 pound pot bust. He capitalized off of drug users and losers his whole career, and let that stuff go on in the bars do he could represent the dealers and kids who got busted. Yea, he's a real prize for this county. I'm a law enforcement officer that has to deal with Ashtabula Muni Court and when Simon was Solicitor, I had numerous arrests of shit bags that claimed that they were friends of Tom Simon and furthermore, they would get out of the charges because of this. At that time I was new to this area and thought that they were just talking crap. Unfortunately, I found that what these drug addicts and criminals were saying was true. Most of the reports never made it past Simon's desk and these shitbags were out comitting the same exact crime the following week. Seeing is believing and I have first hand experience that Simon is crooked as the day is long. He needs to stick to being a defense attorney , defending all of his buddies. It's perfect for him because they can retain him with cocaine and weed if they don't have any money. And if you're a female, sexual favors will do for payment. It's all true.

It is very hard to deal with the way my case was handled in this trashy town. There was no justice and it eats at me every day. I think every day of the harm and hurt that was inflicted. I also wonder WHY they ruined my life and WHY they got away with it. WHY I had to pay for their mistake.
