When did this supposedly take place? This is funny! Maybe next time, he will get the death penalty and not get off with such a light sentence. I wonder if he has the tape recorder on when he was yelling at Randall say "I am going to come down there and kill you"? It isn't going to matter who the judge or jury is because he is still going to go to jail because the evidence proved that he did it.

i dont know about that, from what i hear some of the reasons frank came off as judge and appointed new prosecution was the guidelines of self defense was justified in this case,it is left up to new prosecution{attorney generals office} if charges are to be pursued or bill to be released but as of now he is charged will murder and will stay in jail until they decide if it was justified or just manslaughter,, but it does stipulate that manslaughter 2nd was the highest charge that can be implemented in this case which is 5 to 10 and with good time bill has over half that pulled looks like a plea bargain to me maybe 5 years probate for 10

Not sure where your getting Frank is overturning the conviction and granting a new trail. Frank wouldn't dismiss the conviction the jury came up with. Every person that is convicted by a jury, has the right to appeal. And that is what Frank said. Billy can appeal to the Supreme Court, and have the Supreme Court go over all the doucuments, and everything that was said in court and in the judges chambers. Frank has no power what so ever in the Supreme Court, so yes he won't be the judge there. So many people are typing crap they are either hearing as rumors or something. I know exactly what has been going on, and everything that happened in the trial, and on the sentencing day.

It is time to close this out the above states the truth. Bill was an innocent man as far as killing the other man without having to do it.. A dead man cannot shoot and he shot Billy twice and Billy not knowing if he could crawl back to his car and to his house had to shoot back at Randall. Don't get in trouble in this county trying to protect your property because you will lose and be sent to prison.
Judge would not step down at the start for knowing previous things between these two and when it was over it was realized he was close kin to Ola Hayes the preachers daughter through the Allens.... They are both kin to the Allens. That should have put him off the case. There was also a jury member whose Uncle who married his aunt was close kin to the Carpenters. His uncle was a carpernter. They said second cousin was too distant to count, I disagree I sure love my second third and fouth cousins. Twice removedfrom your mother and you are not [email protected]@@@@@@@@@
By the way Billy's trailer was shot into and his car had a flat from a shot and his trunk was shot into and his car shot into again. The shots were whizzing everyway not just to Shirley's house.

sure wish you had been on the jury!! don't see why frank couldn't see that.....he is in jail at this time...but...oh well, it's all a secret...won't be in breathitt county that's for sure....don't want the bitches to get their hopes up.......time will tell all...but if your neighbor shoots you, you shoot back, I do hope you are in the click, or you are gone to prison....

Well it has finally happened. Something that should have happened a long time ago. I am not arguing the merits but the conduct of the officials is coming back to haunt them and it is about dam time. Go on line to the Ky Supreme Court and read their opinion and they legally say what the good people of this county have been afraid to say. It also discredits one of our upstanding (witnesses) citizens.

I read it and is told it just like it is. Anyone that has been in that courtroom has been treated like crap (if they are not one of the click or are without money). That opinion basically said one of the witnesses lied, the prosecutor and judge are guilty of misconduct. I wondered how long it was going to take for someone to sit up and take notice. Maybe the next time that one is overturned for the same reasons we will be getting new officials in the courthouse. And believe me it is not long in coming.

That man is right where he deserves to be. He did nothing but put his neighbors through hell. Maybe you should be his neighbor and never know when it was safe to go outside because you never knew what that idiot was going to do next. I find it a shame that the police had to be called to oversee workers that were working on the road because he threatened them by shooting at them because he didn't want around his so called property anywhere. I don't think land is worth killing anyone over. If it were not for the man that he killed, he wouldn't have had a place to live. That family sold it to Bills parents to start with. If we are lucky he will croak before the new trail comes around.

Read the opinion. If Frank and Darrel had conducted the trial according to law you wouldn't have a new trial coming up.

But everyone deserves to have a fair trail,The Supreme court read the case and throwed out the conviction,The court system is not fair in Breathitt county,maybe everyone needs to send their case to the supreme court.I know that if you are convicted of 20yrs or more it goes to the supreme court.less than that goes to the ape allege court
