Did Roberts make his ruling just to make it easier to repeal Obamacare as a tax? Now it takes only a simple majority in the Senate, and it's a done deal. All that it takes is the Republicans to gain 4 seats in the Senate. Then through Reconciliation they could go 51 votes and be the majority opinion. Killing Obama care FOR GOOD. That's why they call him CHIEF Justice John Roberts. He da MAN!!! Pure genius....

And Haha is right; the senate has grownups in it, unlike the House, which is full of teabagger freshmen who think Michelle Bachmann is a genius. That is to say that it will stay Democratic, of course. And over time, repeal will get harder as the benefits of the Affordable Care Act kick in. It's nearly impossible to convince people to give good things up once they have them. This is about Justice John Roberts leaving the Republican side and siding with Obama and the democrats. In other words, people feel that the Chief Justice was playing politics, rather than going by the law itself. Usually, a Republican Chief Justice would side with his own side, in this case Republicans. Had he voted against Obama's Health Reform plan, some think that this would have led to the Democrats trying to bring in limits on how long a Supreme Court Justice could serve. By siding with the Democrats, he made it look like the decision was based upon the legality of paying for it with taxes, rather than looking at it being legal under the commerce clause. As a result, this issue is right back in front of the voters again.

Roberts held that the Obamacare law was unconstitutional utilizing the commerce clause--which was an important if unnoticed victory for strict constructionists. He found that it was constitutional under the enumerated power of congress to tax. I think in this he was correct. He correctly noted it wasn't his job to fix the mistakes of the voters but simply to rule on whether it was constitutional or not. We can undo this mistake by voting out president downgrade and cronies this fall.

I for one am happy that CJ Roberts called Obamacare out for what it really is...a HUGE NEW TAX on the middle class and small business.
