There are 1 comment on the www.journal-news.net story from Aug 21, 2008, titled Man arrested for smoking while driving. In it, www.journal-news.net reports that:

A 24-year-old Kearneysville man was arrested Wednesday afternoon for smoking while driving.

Apparently, a special blend that Jeremiah Brett Miller exhaled from his driver's side window was what landed him before Berkeley County Magistrate Harry Snow. Senior Trooper F.H. Edwards charged Miller with possession of marijuana - less than 15 grams - after spotting him "take a hit" from the cigarette which smelled strongly of the controlled substance. Miller posted $2,500 bond which was set by Snow and was released.
