"FRANKFORT, Ky.(WYMT)- The state supreme court is asking a judge to consider whether facebook tainted the jury pool in a Martin County murder case.

The case involves 28-year-old Ross Brandon Sluss.

A jury found him guilty of killing Destiny Brewer in a truck crash in June 2010.

The court wants a judge to figure out if jurors were truthful, when asked about their exposure to Brewer's, mother's facebook page."

What kind of moron would leave a trail of any type of communication with a member of a Jury in which they are a part of the trail? Bad enough trying to have a fair trial with such a local media spectacle of the poor kids death.

Or, maybe he could get a non bias jury that has not made up their mind before the trail even begins, that will understand that this was not murder 1 but manslaughter, and give him an appropriate sentencing.

Who says he would be stoned driving again in 20 years? Oh Mr Marcus, tell me more about how you know everything in the future!

He should get a new trial .I heard about this on Inez forum that she had to friends on her face book who set on the jury ,to much talk on the news and from people and inter net for him to get a fair trial ,this should of been moved out of Martin co.,Mable Ashland Ky .There is nothing fair in martin co

This same thing happened in a Louisa trial back in March, a trial in which attorney Kirk got a $1.3 million judgment, but the insurance company discovered that one of the jurors was talking about the trial on facebook and the judge throwed the verdict out. Now, they have to have a new trial.

If he's granted a new trial, I wonder if April can stay sober long enough to attend. She condemned him to hell at sentencing, even though she and her family was/are doing the exact same thing. Brandon did not get a fair trial; the jurors had their minds made up before the trial even got started. There was absolutely too much publicity for this case to have been tried in Martin County.

i know brandon but i agree there was way to much talk for him to get a fair trial here but with it on facebook and all over the net do you think it would matter where he was on trial... i dont watch tv dont even have cable but from on here already knew everything and how it would turn out

Yes. It would matter. Cases are not black and white. Guilty or not guilty. There is a story behind everything. Talking to people, and watching the news, and having things shoved in your face can really effect the outcome of a trial.

For example, people are treating this as if it was premeditated murder. People are not thinking rationally, they see red and say 'He killed that baby!" without even taking into account the circumstances that lead to a death. For example, he was intoxicated, not in a clear mindset, was the person weaning a seat belt? And so on.

He needs a new trail, in a new town, with people unfamiliar with the case. 15 years in prison, 15 years probation, 10,000 fine is normal for cases like his. People personally thinking he needs a harsher punishment is irrelevant, this is the way the system is, and it's a jurors duty to respect that.

I think most people are just tired of all the drugs in this county destroying lives!! Almost every family has been touched by drugs in a negative way. It would very difficult to find a jury that would not convict simply because of the drugs involved!

That's the point. People hear "drugs' and "kid" and then they get this Nancy Grace mentality of "guilty until proven guilty." And when you have several jurors that are friends with the mother, do you not see how this could be a bad thing?

We need a jury that will listen to the facts and evidence that are presented in count. A jury that will recommend an appropriate sentencing.

Judge will probably give him a new trial. He throwed out a big million dollar plus verdict in march for selena russell because one of the jurors was posting on facebook about the trial. lawyer that got it throwed out was from lexington. her lawyer was kirk.

yes from what i hear she's very bad on drugs.ppl say the hole familey is bad on them dont know but thats what ppl sayin and she was in the paper2 or 3 times for dui

Doped up driver, with many priors killed a child. He should have been in jail instead of driving that day. Those who say he didn't get a fair trial should realize he got more than one break in life for being on drugs and driving. He had a long list of priors. I wonder how those defending him would feel if he gets out and kills one of your loved ones.

So essentially what you're saying is, because he had a history of other crimes we should just ignore giving him a fair trail?

He had a fair trial. His past crimes were related to the very thing he was doing when he killed someone. He drove impaired on a regular basis, and got off with just a smack on his hand. Now he has killed someone. The hens came home to roost.

He never had a fair trail. A local media circus was made out of the poor kids death. Several jury members had connections with one of the main figures of the case. Negligence from the other party was not even taken into consideration.

His past crimes, while he should had pay for, still would not amount anywhere near a life sentence.

This was and still is a very sad case. There are so many wrongs, the only thing that is certain is that the little girl lost her life. If the Sluss man was driving DUI, he should be punished. If the little girl wasn't in a seatbelt, the driver should be charged. If there was jury misconduct, the jurors should be charged, and Sluss granted a new trial. And the Mountain Wolf should be sanctioned for posting pictures of the jurors in the jury box during the trial on his website.

I was at the scene of the accident and he was so hi he didn't even know or care what had happened. He deserves nothing but death. Life in prison is to good for him. Another trial that's a joke. U dam pill heads deserve nothing but death and that's what your going to get. Your the scum of the earth and care for know one but yourselves and a pill. Just u wait it's coming your all going to get what u deserve. Die pillheads die!
