Disabled Man's Death File Sent to Frederick Co. Prosecutor

Frederick County's top prosecutor is promising a thorough investigation into the death in police custody of a man with Down syndrome.

The gentleman was not a hardened criminal.If three deputies found him so difficult to control,then,they obviously should not be deputies.How about talking and attempting to use reason with your fellow human being? Apparently,they lack any social skills whatsoever.And,this is a sad result of their ineptitude.Many condolences to the young mans'family.

The fascinating legal situation that faces Frederick's mousse haired prosecutor Charlie Smith is that if he treats the cops as the private security guards they were there is little defense since they didn't, as private security guards, have the right to use the force that has even been admitted.

On the other hand if Smith goes the police immunity route and treats this as line of duty the the US Attorney has "under color of law" jurisdiction for brutality resulting in death that includes a potential death sentence and a trial in Baltimore.

They killed a profoundly disabled individual by brutality incident to a refusal to leave their employer's property. They deserve no mercy.

untrue^^ 275lbs man actively assaulting 3 police officers. They committed no crime and will not be prosecuted.

He was killed in handcuffs. Even the Public Affairs officer concedes this. No claim of self defense or safety has been made.

On the issue of prosecution you just might be correct that they will escape prosecution for 2 reasons.

1. Their employer did the investigation.

2. The FBI Special Agent wife of prosecutor Charlie Smith, Desiree Skinner Smith, has too many ties to individuals in this case for Mr. Smith not to be conflicted.

The ongoing publicity is going to make it difficult to bury this one.

So what he was in handcuffs? People have medical emergencies all the time. The victim was out of control and should have been handcuffed.
