Don't they have machines and tests they use before they arrest someone that gives them an indication of what the levels may be?

If there is an arrest, I am sure there is a report. Those are public records, I think. What does your research show the arrest rate of people who test under the legal limit to be?

Wouldn't the Magistrates dismiss charge based on lack of probable cause for an arrest if the machines showed evidence of a level below legal limit and no observable signs of impairment?

I really would like to hear more of how these pigs are doing it wrong. Who doesn't like to drink and drive.

Exactly. The machines they use in the field are actually not admissible in court as proof, and even at that they have to wait at least 20 minutes to used them to give probable cause. They also have to supply the calibration method and log. One things that has not been touched on are the factors which make any machine determining accurate DUI levels very difficult which is medical conditions and medications. Smoking, diabetes, hyperglycemia, and reflux are all conditions which can render a analyzer useless. New legislation was just passed in WV to make the submission of analyzer tests much less valued.

Mouth alcohol/slope detector?

Prescription medication mixed with alcohol? I don't think the drug manufactures suggest drinking and taking meds together. Poly drug use I think enhances impairment, general speaking?

I wonder if a pig pulls someone over suffering from the effects of Hypoglycemia if they may save their life. Please look up the condition of a person suffering the effects of a hypoglycemia diabetic episode. They are seriously sick and a danger to themselves and people around them if driving.

GERD research has been done and ruled out as a common denominator except in extreme cases where the suspected drunk driver can have there doctor testify to their diagnosis. Plus, as long as the drunk did not have a flare up during the 20 minute observation leading up to the secondary chemical test the test will be good.(Mouth alcohol slope detector). Plus, I think these people are controlling there disease with diet and medication.

Smoke is not a factor either.( 20 minutes).

What is this new law you speak of. My clients may be interested in new defenses?

But hey, I think we need to tell this pigs to stop making our roadways safe for citizens. After all what can a drunk really do to our communities?

the only good drunk is one in the police unit after getting blue lit and wearing cuffs crying i gotta piss ill pee myself vehicle getting towed and inpounded and drunk on way to jail i better day could not be had and even better then drunk gets letter of suspection from d.m.v. due to d.u.i. bye bye lic so drunks get over it deal with it its all on you

How many drinks are too many to drive? How many drunks say "naw, I'm too drunk, you take my keys cuz I'm not alright".
Buzzed driving IS drunk driving. One is too many to put to risk lives. No life is worth it.
For those who get a DUI and do not hurt/kill someone, then you've just been given a gift. It may end up being your most expensive drink ever (after the court costs, lawyer fees, bail, impound, missed work etc etc etc), but it's a GIFT from God you are not hurt/dead and noone else is. Play it smart, take a cab. Plan before you go out. Everyone has phones, phone a friend. So many options where one doesn't have to be risking life & limb - literally.

Since he can't afford or identify a cab, he's probably just white trash that has so many "cousins" he wouldn't notice if one died. Or he'd be too drunk to notice.
