One more example of over reaching by government without consideration for private property rights or common sense. The DNR has an attitude that they are always the final decision maker. We need to change the way they do business and how they consider the rights of the tax payer of this state first, rather than falling back on the attitude that they are always right and will not compromise. Just ask any farmer or business owner in the state who is the most difficult agency to deal with, the answer is always the same, but don't forget the EPA is a close second.

this problem is similar to what happened to me in the fact that it is all going back and forth between lawyers. They paid back his legal fees of 82K plus the DNR has legal fees, and the watershed district has their legal fees I bet there has been 250K in legal fees paid because the lawers dont want a solution. In my case I wanted 2000 dollars when it was all over the city had spent over 80000 dollars and I got 2100. Fire the legal team and put it back the way it was.

I love it when government agencies fight with each other. Just another situation where an ignorant enity tries to flex it's pathetic power over another.

Who is taking here? The ditch changed historic land patterns and some bozo judge wants the state dollars to compensate for this? Why not have him (the judge) pay for it. Takings is in the eye of the beholder, just like those tea party nuts who claim we should keep "our hands off their healthcare" which we pay for. This society has devolved into who screams fault the loudest wins. Washington County judges are "taking" my money to reimburse a local government official who was paid by the state (the owner was the "former" mayor). Bet he knew the judge, nice little scam up there in Washington County.

Hey Nut Job: this is a taking. The farmer had tillable ground. The govt agency, saw to it that a portion of that land was flooded and could no longer be tilled, thus " a Taking". Like you, it is pretty simple.

Ignorant people always seem to know more than the experts. Local units of government are usually run by narrow minded, uneducated goof-balls that seem to have all the answers or are just crooked.

Drainage Rights were enacted by an act of Congress. Like it or not, without this act, this nation could not come close to producing enough food for the American public. But then again, elimination of the Act would solve the obesity problem and reduce the above mentioned health care issue. Some parts of cattails are edible. One just has to fight the muscrats and beaver for the best parts.
