Jim Ragsdale: Error, trial and issues around the Koua Fong Lee case

Full story: TwinCities.com

The drama of Koua Fong Lee was the stuff of 'Law & Order.' In one day last week, Lee turned down a prosecutor's offer for freedom from prison in exchange for acknowledging his guilt, watched and listened to a Hmong interpreter as a judge ruled that he was entitled to a new trial; and then emerged from custody to tearfully hug his wife and lawyers ...

Of Koua Fong Lee's accident. What I would like to know is how come the reconstruction team didn't look at the police report which showed the series of events that took place during and seconds before Koua's accident. The police report stated (as shown in the hearing 2 weeks ago) that Koua had FIRST side swiped a Solera - that was when #1) his left brake bulb exploded because it was the left side kf Koua's car only that was involved in the side swipe. and #2) that was when koua had hit the brakes and lost all brake pressure since the throttle was stuck open and he DID have ABS brakes. IF the recon team was correct in their determinations when they said the van was the first car Koua hit and that was when the left brake bulb broke then WHY didn't BOTH brake bulbs brake at that time. Does not make sense. How could the recon team have gotten that so wrong. Two critical things. When Koua side swiped the 1st car/Solero (as written in the police report) and his left brake bulb broke at that time, that means he was applying the brakes. And it was after that second that he lost all pressure in his brakes. He WAS trying to stop that car long before reaching the van.

I personally do not understand how they found him guilty of gross negligence. What exactly was the evidence of the "mulicious intent" on the drivers part? That's what I will never understand. I believe the emotional pain of the victim's family played a big part of how the jury reached their decision. I know that the jury went back to the judge before they reached a verdict and asked the judge if there was something else they could charge Lee with. Somewhere, some rules have to change in our justice system. How could this have happened. The sad thing is, there are many other innocent people sitting in prison that were ripped away from their loved ones - paying for a crime that they did not commit. What would YOU do if you were one of those people and you had no money to fight for your rights? The charge of vehicular homicide should have NEVER been allowed.

"...Lee's case became a national cause, blessed even by relatives of those killed when Lee's Camry rammed into them..." Of course they are pleased by the dismissal. The relatives of the deceased are looking for mega bucks via their civil suit against Toyota. Their case benefits from Lee's new found innocence.

Well frankly, the victim's family deserves millions from Toyota. Toyota KNEW about the 1996 camry cruise control problem since 2003 and said nothing to anyone about it. They didn't care that people's lives were at stake due to recall they refused to do. I hope there are enough people to sue Toyota so they go bankrupt. 3000 accidents just from sudden unintended acceleration and 86 deaths. It's disgusting - and still they have not done a recall. The other auto dealers have done their recalls.
