WHITEHALL -- Not many 57-year-old women have 2-year-old children, and even fewer have five children younger than 12.

So when Elizabeth A. Bushman, 57, of Montcalm Street, Whitehall applied for free Christmas toys through the Marine Corps League's "Toys for Tots" program asking for assistance, questions were raised.

Days later, an investigation by Toys for Tots and Whitehall Police led to Bushman's arrest after it was determined she did not have any children, said Whitehall Police Chief Matthew Dickinson. She lives in a one-bedroom apartment just a few doors away from the police station.

Bushman was charged with a misdemeanor count of making a false written statement for filling out a sworn application that indicated she has five children between the ages of 2 and 12.

Toys for Tots determined her application was fraudulent before Bushman received any toys this year, said Tom Golden, the program's coordinator for Washington, Warren and northern Saratoga counties.

However, Golden, a retired Hudson Falls Police officer, said Bushman has received toys from the program in the past, gifts that appear now to have been fraudulent. He said the program probably would not seek to have her prosecuted in those cases in light of the new case.

"I think she should be made to do some community service," he said.

Dickinson said Bushman told police she did not fill out the application, and she cannot read. But she acknowledged signing the application, he said.

"She said the toys were going to her grandkids," Bushman said.

But the application stipulates those who are applying can only seek assistance for their children, and the children must live with them.

Bushman was released pending prosecution in Whitehall Village Court.

Arrests for fraudulent Toys for Tots applications aren't unprecedented. A Glens Falls woman was arrested in 2007 for applying for toys when she did not have any children in her custody.

Golden said the attempted fraud comes as applications to the program have nearly doubled this year. Last year, 300 families applied and received assistance, but this year, 600 have applied so far.

He said organizers weeded out four other applications they believed were fraudulent, but criminal cases weren't pursued in those cases.

"This one was so blatant we had to do something," Golden said of Bushman.

I no of a women that lives in Ti did the same thing she got toys fffffrom several programs and then beause they still had tags on them she returned them back to Walmart and they gave her a store credit she was turned in and nothing happend to her guess it depends who you are!
