When something is constitutional it is in the constitution before congress passes any law. For example, Is the US Army constitutional? Yes. Why? Because the Army is in article 1 of the constitution. Therefore if Obama care is constitutional tell me in which article or amendment we may find it.

Yet, even the most rock-ribbed constructionist allows that the Necessary and Proper clause, contained in Article 1 section 8, demands that congress be able to pass laws from time to time and in the national interest in support of one or more of express powers afforded that body in the same clause. In the case of the Affordable Care Act, the supreme court ruled that congress was, in fact, able to pass such a bill under it's power to levy taxes. Obamacare, under that view, is a tax.
