Ruling clears way for vote on new Mastic Beach village

A State Supreme Court justice has tossed out a challenge to a proposal for a new incorporated village in Mastic Beach, meaning residents could vote as early as this summer on the creation of the new government.

I am pleased that the Article 78 was dismissed. The people of Mastic Beach will finally be able to decide whether or not to make our hamlet into a village.

The leadership of the PCCA and MBVEC should be proud of themselfs. Without their leadership we would not have got this far. CONGRATS to all who worked hard on this. BRING ON THE VOTE!

I was not aware that the MBPOA President Bob Debona and MBPOA Board of Directors Member Maura Spery hired an attorney to stop the vote on a village in Mastic Beach.
The MBPOA and Director Spery are now going to file an appeal to again stop the people of Mastic Beach from voting?
To appeal this decision will cost between 25 to 30 thousand dollars.
I guess the MBPOA and their members have lots of money to spend so they can delay this village vote.

It is just too bad that the members of the MBPOA have no say in how their money is spent. There is a dictatorship run by Mr. DeBona and his Board of Directors that feel they can do anything they want without coming to the members.
Pretty sad.

If the MBPOA appeals this decision, there won't be a vote this year.
Maybe the MBPOA should be more concerned with their own MBPOA Board of Directors.
One of the MBPOA Board of Director Members has been renting a house in Mastic Beach where the tenant is illegally operating an auto repair business in the backyard.
Not good for our community to have oil changes draining into our creeks and wetlands.
But then again, the President of the MBPOA works as an active realtor for a local real estate company.
It seems the "interests" the MBPOA is protecting are their own personal real estate business interests. Over and above the membership. Without consent of the membership.
And at least two MBPOA Board of Director Members own multiple houses and rent them out.
So maybe the MBPOA should cleanup their own backyard before they hire attorneys to stop us from voting.

As a member of the MBPOA I am sick that most members are so apethetic and allow these things to go on. Why don't people stand up for what they feel and get rid of the leadership that is bullying us.

They are spending this money in the interest of "protecting the MBPOA interests." Isn't cash a MBPOA interest? Isn't cash the member's interest? They think it's their own piggy bank that they can use $ as they see fit without membership consent.

You're going to hear alot of lies in the next few weeks. Lies such as the village wants to take the club house and the marinas. Fact: the PCCA and MBVEC has no interest in taking these. They'll counter by saying it's in the MBPOA deed and bylaws that once a village is created, it's automatic. OK, fine, that maybe so. Then look at it this way, right now you have to spend, I think,$45/year to use the one beach they have. Once the village is created, the beach is open to all residents of the village. No fee involved.

You're going to hear that taxes will go up as much as $2000/year/house. Really? How many homes are there in MB? Two thousand? So, by their logic the village will be collecting $4,000,000/year in taxes? Don't think so. The MBVEC lawyer explained that the portion of your property taxes you pay to the town of Brookhaven will decrease by a pre-determined amount. That decrease will then be labled as "village tax." That folks is your "village tax." The franchise fees that LIPA, Verizon, Cablevision pays to the TOB will now be paid to the village directly.

Another item you're going to hear is "budget." A budget will be established by the elected officals when we vote for a mayor and trustees. Please look at the budget for the Village of Huntington Bay. Remove the "police" line,(because we will not have a police department), and it looks like ours. And it's not nearly 4 million/year even with a police department!

Highway, lighting, trash removal, fire, ambulance are all billed on your property taxes as a seperate line. These services can not charge higher just because we're a village. Since trash removal is subcontracted out by the TOB, we will have the ability to negotiate a lower rate.

Federal funds. Remember the Nor'easter of March? Know where the FEMA funds went to? That's right, TOB and Suffolk county. If we were Inc. then, we could apply for and receive federal funds.

Don't fall for the fear tactics of those opposing the movement. They have their own personal interests to protect.

The last meeting I went to, a member got up and tried to introduce a motion on the floor.
The MBPOA Director then slammed the wooden gavel down, declared "the meeting is over", and they made a 911 call to the Suffolk County Police Department to clear the hall.

Bob DiBona, as well as Mr. Summa, an MBPOA board member, who had an article published in the 'South Shore Press" last week, are both part of "Stanzoni Realty", one of two huge real estate comp. out here that has worked over the years to have codes changed in their advantage to overbuild and put houses on lots that were at one time not cleared for building. This company also was deeply involved in having the "CVS" on the corner of Neighborhood and Wm. Floyd Parkway placed at its current location - the initial plan was to have CVS placed in the business district of Mastic Beach. Many of the small businesses would have profited from having CVS placed there, but DiBona and Stanzoni did not allow that to happen - instead, Stanzoni now holds a 30 year lease on that corner with CVS.
Add to that all the houses now either vacant or substandard while that real estate company continues to rent to DSS as well as taking advantage of Section 8, and one has to say to themselves what are the MBPOA, Bob DiBona, Mr. Summa, and the rest of the MBPOA really scared of.

Look at Mastic Beach, and how it's denigrated over the years - your flooding issues have worsened due to the sheer mount of new houses built on roads that are themselves as wide as the houses built on them.

The last thing the MBPOA is truly concerened about is your taxes - it's their profits, nothing more. To deceive the voters by stating only cons, with no pros, at their meetings are testament to the fact that this entity cares only for themselves.

The MBPOA has now made itself a major issue.
The reason the MBPOA did not sign the 78b is because it is illegal for them to sue to stop the village election.
The reason it is illegal for the MBPOA to sue to stop us from voting is a simple one.
They are a tax exempt organization under New York State Law.
IF the MBPOA is smart, they will drop their appeal and let us vote, otherwise their tax exempt status is at risk.
But then again, we know they are not smart.

Great post!

As we can see, the police department alone takes approximately 80% of their total budget - and M.B. has no interest in placing constables in the village - the SCPD would still have this job.

Huntington would in essence have a 1.3 million dollar SURPLUS were they to do away with their own police!
