Here in my home state of Florida they are thinking of passing legislation to confiscate the cars of repeat DUI offenders like this. Good idea.

They tried this on Long Island at one point but it didn't last. I think the ACLU stepped in. What if you borrow your Grandmother's car and get nabbed for DUI? How does she get to the doctor or the pharmacy? What if the wife gets caught but the family has one car? How does the husband get to work to feed the kids? The plan had good intentions but maybe was a bit impractical. If you're convicted of DUI even once you should have a breathilyzer put in your car. That would at least keep them off the road while they're drinking and protect our families and loved ones to some extent. If they don't drink they can drive.

Drunks are creative and clever people, and it would not take long for someone to be a "designated blower" to get a bunch of cars in a bar parking lot going.

On the other hand, other people are clever too, and if they KNEW someone borrowing their car could lose it for them, their source of cars to borrow might dry up real quick.

In the two instances you cite, it might be a month impound and warning that the next one is for keeps.

I think they have a law in NYS that your car gets impounded if you are arrested for DWI. Any help here?
