I expect that even though he was using unsafe, ill-conceived, improvised equipment, some skumbagg lawyer will chase that big paycheck via a frivolous lawsuit. Pathetically, they will find enough gullible nitwits to serve on the jury to make this happen. America is spiraling down the toilet.

Why is it frivolous if there was negligence by the employer?...

If it was the employers fault because he didn't want to spend the money on safe equipment, I say sue!

If it was an on-the-job accident, using safe equipment, Worker's Comp will pay a set amount each month for the family. That's it. You can sue all you want but if it wasn't all-out negligence, there will be no extra money. Worker's Comp is to protect the employer for false or un-warranted law suites. To get any more money than Worker's Comp, you have to prove negligence!

Secondly, why shouldn't the family sue? Some kids are now going through life without their father, the woman lost her best friend and soul-mate (maybe), and his parents lost their son. Some poor hard working guy goes to work, and never returns.

Why would there be a "home made ramp" at a supposidly commercial auto repair shop? And why weren't the wheels chocked?

This is a very sad case.

I hope the family gains strength through their faith in the Lord.
