Bruce Eric Payton will be full of rage by the time he gets out.

Some of Elizabeth's family members previously said they were angered to learn that prosecutors declined to charge the driver of the truck, Caper. Sandra Toribio has said the state attorney's office did not bring any sense of justice for her family by declining to charge Caper. She said she wanted Caper to be held responsible for what he did.

Assistant State Attorney Ed Brodsky previously said Caper was not charged because he was in fear and that his actions were done in an effort to save his life and the life of his crew.

He's 49. Got 25 years. That's 74 if I did the math right.

Pretty much a life sentence.

Caper, was the one responsible. Are we sure he was trying to save his life?

Elizabeth Toribio was my 1st cousin and I feel that both men envolved in causing the awful accident that took our lizzys life should share in punishment! If you have a accident that was totaly out of your control but you were the driver and it caused a life to be lost in most cases you are responable in some way by law and charged with man sluter, whats wronge with these people the truck driver needs to be charged as well!

Lele was one of my close friends we were having fun enjoying every moment and now she's gone leaving so many memories and missing so alots of things that she wont't ever be able to experience just because of a stupid m.t.f who decided to run over a red light causing so many damages to her family and friends.I really think both men should be in jail for life after taking a young girls life without thinking!People need to think on other people life and not only on themselves!!I really miss her but she is always in my heart no matter how much time goes by.R.I.P.Elizabeth I Love You with all my heart<3

Common sense tells that there is no way to completely stop road rage, because some individuals are simply to far gone. However, I do feel if the punishment was extreme enough, many would control their violent emotions. Since the punishment should fit the crime, I say allow the families of the victim decide, and honor that punishment.

that is so wrong for you to say and he got killed because of someone's ignorance he was fearful for his life and it is sad that the little girl died as a result of the idiot chasing him down the street with a gun...so know your facts before you speak about my husband

That little girl's name was Elizabeth Naomi Toribio age 14 and as for your husband he was a POOR excuse for a human being. He never showed compassion to my family as we all sat in a crushed car on the verge of death. I do believe in Karma. He NEVER once extended his condolences to my family not once even after the trial did he say he was sorry that my sister died due to his decision. What made his life more important than a girl who was smart, beautiful and ambitious? His choice affected us more than himself. And who was he to pick that for us? Tell me did he lose sleep? Did he ever talk about my sister? Did he have any heart? All I wanted was for him to acknowledge what he did to my family. And of course he didn't. Even the man who is serving his time in prison had the heart to apologize to us. Darien didn't I must say once I found out that he was killed a part of me was happy. I gave the news to my family and I must say we all had the same reaction. I have read your "husbands" record he was NOT a good man. He had several charges in another county that were driving related. Apparently he wasn't so great. I am sorry for your lose however I am not sorry that it was him.I hope the person responislbe for his death shows your family more compassion than he ever showed my family. It's true how my dad says everything you do in this life doesn't go unpaid.

The driver of the truck was driving away from a man firing a gun at him on the road! He tried to save his life and did not intend whatsoever to harm anyone else. Im sorry for your loss but its 100% the gunmans fault and not the man who ran the red.

Mr No name is Glassboro, NJ, They were BOTH responsible for the accident that took my sister, put my brother in a coma and added a metal plate and six screws in my arm. "He tried to save his life and did not intend whatsover to harm anyone else." My ASS. He started a fight with the other driver he couldn't finish. I am sure you don't know the facts of this case so let me enlighten you. That truck that t-boned my car had SIX grown men in it. The car chasing him had a whole ONE man. If they were in so much fear of their lives from where the fight started to where my car was hit was a good five minutes with several roads they could have taken as alternates to avoid further confrotation. ALSO take into note that while my family sat in a crumbled car holding on for our lives the MEN in that truck rather than walk 20 feet to check on us in the car proceeded the other direction to get rid of the beer they had in the truck. ALSO there was NO gun found. No shell casing. Nothing on the truck that proved the existence of a gun. But it's much easier to take the word of six people versus one. That one that was considered a convicted felon. So Darien Caper should have been charged also but it's much easier to go after the one with more of a record. And Darien Caper was also driving out of the class of license and wasn't cited for it.So both men are to blame. Which eight year later for me has become a mute point. One is in prison and the other is SIX feet under the ground where he belongs. The only person that is still relevent in this story is Elizabeth. The fact that she was robbed of her life. That her nieces and nephews will never get to hug and kiss her. That my parents had to bury a child. We have to do holidays and birthdays at a cemetary. As as much pain my family has suffered I would NEVER hope any of this for the lowest of low person. So before you take a moment to comment on something make sure you have ALL the facts and not just an opinion.
