Does anyone know what they do for first time dui in Hamilton County. I have never had one in the past 10 years and someone told me they give you 7 to 10 days in jail and a 1000 fine, Im out of state in Ky and was coming back from Alabama after dropping my aunt off and had been on the the road driving for quite awhile, when I decided I had to much I was trying to change lanes and got pulled over for going 3 lanes, with signal on and he said I was swerving in and out of traffic. I was just trying to get to the right hand lane to get off at next exit. I was honest and told him I had been driving too long and my back started hurting and I took a prescribed pain pill at my aunts, ate dinner and left. I have early stage parkinson and i passed all the sobriety tests except the leg stuff, heel to toe walking and standing on one leg cant do it then cant do it now. But anyway any info would greatly be appreciated. I have a full time job and a 5 year old and cant be spending time in jail for something stupid

When you go to court take a note from your dr saying you have parkinsons and there was no way you could have passed that part. Have you EVER had a DUI? Even passed 10 yrs ago?

I am on perscribed pain meds, pretty strong might I add. My doctor told me that it was not illegal to drive while on them as long as you can function and they don't make you dizzy etc. From what she explained to me if you got a note from your doctor stating that you can drive while on them they can NOT get you for a DUI. As far as the charges go. You will have to pay a couple hundred dollar fine and they say 3 days in jail but most of the time you dont have to spend time in jail. I hope this helps.

Thanks, I do have a note from my Dr. saying I have Parkinsons, so I'll take that with me. I got a DUI when I was in college for alcohol in 1998, but that was it for me and drinking, scared me to death like this one, and if your from out of state no bondsman will get you out so I got alot of cash riding on this crap. Had to stay in lock up for 12 hours waiting for someone to come get me. NIGHTMARE

That is BS considering it only takes 3 hours for oxycodone to be out of your system. Not your urine or blood, but for you to not have the effects of it anymore. Good luck!

Bull shit about the 12 hour wait. I used to drive to Fl a few times a month.. I got pulled over once and searched. I had everything that I should have and the cop said " mam, have you taken your medication?" I told him i had, but I could drive on it. He didn't have a problem with it but told me next time I took one if i felt any effects from it to let my husband drive. Was very nice.. I was scared to death I just new I was going to jail!

First off it was a oxycodone 5 mg, not the pill mill BS people drive to florida for. I had to wait 12 hours cause thats how long it took for my family to come get me. Took the jail 4 hours before I could call my husband to tell him where I was. You need to stop taking yours and focus on what your reading. The had enough part was driving, not meds, I was pulling over to take a nap, I was tired. Guess this topix is like all the rest, have all the a$$holes waiting to pounce

Oh well, next time I wont share my expirence.. maybe next time I won't be so nice since most people are like.. well you stupid pill head nasty arse sk*nk maybe you shouldn't have injected your meds and you wouldnt have got pulled over.. but I didn't because I take my meds CORRECTLY and I take more than 5 MG.. and can still drive.. thought it was stupid they would charge you for that.. You are right.. she was the ass that couldn't wait to punch we I was defending her and telling her my expirence.. or maybe she was feeling guilty and decided to take it out on me because I knew exactly what she was doing.. but I take my meds and take them correctly and can drive.. i thought it was bullshit that the cops charged her with a DUI for that.. but you know what.. next time ill be like everyone else on here and insstead of being nice and taking up for her or anything like that ill just say.. Well, you stupid pill injecting druggy, if you werent traveling to go get pills from GA/ AL/ or Fl and being all fked up your arse wouldn't have gotten pulled over in the first place.. you deserve to rot underneath the jail, these pills have got out of control and people who are in real pain can't get their meds because of druggys like you.. Oh and BTW.. I knew you had DROVE TOO LONG AND WERE tired.. not that you had taken too much meds.. I said the meds are out of your system in 3 hours.. you said you had taken your meds hours before.. therefore the effects shouldnt have impaired your driving.. therefore you shouldnt have got charged with a DUI.. It was bullshit they they kept you in jail for 12 hours waiting for someone to come and get you when you could have drove out of there.. because your meds had wore off.. I am so sorry you didn't understand what I was saying.. maybe you need to lay off the drugs or alcohol.. or maybe I need to spell it out for you since you are getting way too defensive and jumping to the gun when I was only defending you.. good god.. stupid arse.

This is by far almost the best post ive seen here in months! You hit the nail right on top of the head. They probably did think she was drunk, argumentive, and a down right Biznitch! It just don't add up as to why they wouldn't let her drive home especially if she lived in KY and got arrested close to Chattanooga!!! Even if she did get charged with a DUI (drunk) they will make u sober up then u can drive out of there.. so there is something more to that story than what has been said because legally you are allowed to drive while being on pain pill, if you are taking them as perscribed and not acting like a drug addict. Wonder if she was nodding? Wonder if she watch itching her nose off, wonder if she was tlaking alot ( like when you get that good buzz going on.. example.. when they increase your dose for the first time and you get that good feeling) and just couldn't shut up. Well, thanks for all the useful info. And to Goofygal1985, I apologize for pouncing, and I did. That's not like me, was having bad day as usual and just read the post wrong. I went to court on the 22nd and it was thrown out, blood and alcohol tests from Nashville showed very very small traces of oxycodone which they described as being well below theraputic level. So judge agreed that I was just tired and I was fined 200 for some stupid charged which added up to endangering others cause I was driving too long and was tired. Again very sorry for the asshole comment I made to you. I do have to answer one question though, the reason I couldn't drive out of there was first off I had a passenger with me who went on home after she found out it was going to cost a thousand dollars cash to get out, cause bail bondsman there dont bail out of state people out. So it took her 4 hours to get home, my husband had to wait to the bank open to get the money out and drive back thats why I was there for so long could of been out in 4 hours if it wasn't for that. Hope you guys have a very wonderful holidays.

Oh, and my passenger was 67 years old and I was more scared of her driving than my own even if I was sleepy and tired. She has had to file 2 insurance claims for her car just getting out of her drive way,lol. So, yea I probably should of just let her drive and went to sleep so I couldnt see her doing 40 in the 70.

Because in Tennessee their crime lab is in Nashville and thats where the tests are sent. The hospital drawed the blood, then a release was signed, the samples were then put in a envelope with all my info and sent there. It's like here in Ky, all DNA, blood samples and what not are sent to Frankfort where the lab is. The prosecuter had told me before court it takes sometimes up to 3 months to get these misdemeanor blood tests back but mine was already back and I was one of the lucky ones. I guess I was

Call david barrows. He will charge you a very reasonable amount and you will come out fine an even get it off of your record at the end. No probation no drug tests nada. Trust me. If you can't find his number on google message me.
