If she wasn't smoking 2-3 paks of cigarettes a day maybe, JUST MAYBE, she would've been inside with the OTHER WORKERS instead of hanging outside on their cellphones smoking one cigarette after another.

Not only was she outside smoking a cigerette while her daughter was dying, but while she was supposed to be in the class room assisting, she would be gossiping to all her little friends at the school. So if you ask me, SHE WAS PART OF THE PROBLEM and yet she files a law suit on the school and trys to publicize them as a horrible school. Yet she was never supervising the children when she was supposed to be. What a hypocrite!!!!!!!!!

My sister was not accountable for what happened to her daughter. She dropped her child off just like any other day expecting to pick her up after the school day as perfect as she was in the morning. I don't want to go on because I will say something I regret

How dare you say she was outside smoking a cigarette while my niece was choking? Were you there to witness this? What really happened is that one of the assistants left to use the restroom and that's why my niece was unsupervised. My sisters actions had nothing to do with this.

I didn't have to be there to know she was smoking a cigerette at the time the incident occurred cause from what I understand, she WAS always either outside smoking, on her cell phone or chatting it up with other staff. YOUR SISTER WAS part of the problem with that school!!! The school sucks, and your sister was very helpful in making them suck with her lack of supervision.

I have been following this forum for quite a while without leaving a comment. My heart and condolences go out to the family. But I find myself confused. Jeannie, in your earlier posts, you said that this was an accident and that the problem was what happened after she started to choke. But recently you said that this tradgedy was preventable and that the teacher/assistant left the room to use the bathroom. Can you clear this up for all the concerned parents out there, such as myself please. Also, if the teacher/assistant left to use the bathroom, why did she leave the kids alone? I'm not getting the full picture...please explain.

I cannot elaborate too much but even though this was an accident, it could have been prevented. If Livi had been attended to in the proper manner right after she started to choke, then maybe she would still be with us. The kids weren't left alone, there was another teacher in the room but I believe her attention was with another child. There are a few accounts of what happened but either way my family and I have suffered a great loss and I find it despicable that some people feel they have the right to speak against my sister during such a grief filled period of her life.

Thanks for clearing it up as much as you could. You and your family are in my thoughts and prayers. And I hope that somehow, someway, you and your family finds a way to live with this awful tradgedy.

This poor baby died of a horrific accident. It could happen anywhere. People/Babies choke and die everyday...it's called an accident. Stop torturing yourself with blaming people and going through a horrific law suit. In the end, your going to suffer because you have to relive that day. This mother is a serious hypocrite and really needs to realize that accidents happen...oh wait she does realize this...she even has a friend who she made that had a baby drown in a bath tub...now that's sick...and the mother was negligent but she could find a way to understand her and not what happened to her daughter. Stop being so blind...it was an accident my dear. Accept it and maybe you will be able to move on for the sake of your remaining children.
