he settled a malpractice suit and did not claim any wrong doing.. he has got to be kidding.
If you settle something you are admitting you were wrong or else a complete idiot for settling.
I happen to think he is a complete idiot,who thought he would get away with it,
Where is the court of law that says you can settle and not accept guilt? Why because the health department is involved?
If that was anyone else they would have been in jail .
You have to love the laws in the State of N Y ...where else could someone pull off what this so called Dr, is.

The article said he continues to practice, I can't believe his patients continue to go to him after this! How can this guy look his patients in the eye?

Apparently you are completely ignorant to the meaning of the word settlement. Whether it's in NY or Fl, doctors settle malpractice suits all the time, and with no admission of wrongdoing. Many times it is less expensive to settle than to fight, and it is up to the malpractice insurance company whether to continue to fight or to settle.

Why is this man still practicing medicine? He should be in jail for what he did. I hope he gets sued for every penny he is worth. May he never get a days rest. He should be ashamed of himself.

Is there any site on the Internet that you can check to see if a doctor has had malpractice suits filed against him so you can protect yourself? For instance,if you just moved to New York to prevent a person from unknowingly becoming a patient of Harvey Finklestein?

How can the public protect itself from rogue doctors?

A good man would care about his patients' well-being and would not re-use syringes. Anyone with an ounce of common sense knows you do not re-use syringes. It is inconceivable that a doctor would not know this. He should lose his medical license.

Go to www.nydoctorprofile.com and you can search for doctors and it will show if the doctor has been sued for malpractice.

Keep in mind that the vast majority of doctors have malpractice insurance and are not paying for their own defense, or they pay "only" a portion of the first $25,000.00 of their defense costs, with the carrier picking up the balance.

"Finkelstein, who did not admit wrongdoing in the settlement and continues to practice, now has settled 11 malpractice lawsuits in the past eight years, the Department of Health said. Fewer than 200 of the state's 80,000 doctors have settled that many cases, according to Washington-based consumer group Public Citizen."

The fact that he continues to practice does NOT settle things to everyones satisfaction. The missing component here is his FUTURE patients.

It is immoral to take a settlement from this guy and unfortunate as it is for me to say, the victims should be ashamed of themselves. They should have allowed the path to go till it ended.
With his license to practice in NY State removed!

How they going to fell when he damages his next patient and they're responsible? What if it's a little kid? Shame, Shame, Shame... I would not take a dime from this idiot, and if I had some of the complications they talk about, well then I could assure you the Doc's biggest problem would be praying for regular bowel movements!!!

No admission of any wrongdoing? Just un-f-r-e-a-k-i-n-g REAL... SHAME on you for taking the MONEY!

you are obviously not a lawyer or insurance person. we settle cases all the time because it's less expensive than taking them to trial. people who aren't really injured, or who ar einjured but not by the defendant, often collect $$ because the cost of litigation is outrageous.

Newsday had reports of at least three other doctors, none of them Jewish, who did the same thing...reports buried in the middle of the paper, not the front page.

i just thank god my mom's tests came back clean. she was one of his patients in the time frame. it's such a shame because he really seemed like a nice person. i guess his ethics were a whole other issue.

Did you know that you should give thanks to the Jews for penicillin, multiple kinds of antibiotics and a host of other life-saving things? That's what I'm trying to figure out. This doctor should have had his medical license taken away. It's no wonder why they keep complaining about the cost of malpractice insurance.
