A third teenager was charged Monday in the weekend shooting death of a Hickory man, police said.

Damion Armstrong, 16, was charged with murder in the death of 34-year-old Mario Anthony Mitchell, who was shot 'more than once' Saturday afternoon outside a friend's home, said Sgt. Scott Hildebrand of the Hickory Police Department.

Police have also charged Donald Simpson and Christopher Steven Wright, both 17 and of Hickory, with murder in connection to Mitchell's death, Hildebrand said.

Shortly before 4 p.m. Saturday, Mitchell was having an argument with a few people outside a northeast Hickory home, witnesses told police, when he was shot. Mitchell was able to crawl from the street into the house, where he died, Hildebrand said. Read more

STRICTER SENTENCES SHOULD BE IMPOSED UPON THESE YOUTH. THESE YOUNG PEOPLE ARE NOT CHILDREN. THEY DO KNOW RIGHT FROM WRONG. THEY SHOULD FACE THE FULL MEASURE OF THE LAW, STOP MAKING EXCUSES FOR THEM. IF YOU GAVE THEM THE DEATH PENALTY AS THEY GAVE MR. MITCHELL THEN SOME OF THIS CRIME WOULD BE STOPPED.

Nothing better to be said!!! Not all young people are like this, but the ones that are should be held responsible as adults!!
This thing of parents turning their heads and being in denial is "for the birds"!!

I AGREE WITH NADINE..GIVE THEM WHAT THEY GAVE MARIO. IN MANY COUNTRIES PUNISHMENT IS EQUAL TO THE CRIME. STOP PUTTING THESE THUGS BACK ON THE STREETS. TOO MANY OF OUR YOUNG MEN ARE DYING AT THE HANDS OF YOUTH WITH "NOTHING TO LOSE". LET'S TAKE OUR COMMUNITIES BACK...PLEASE LET'S DO SOMETHING PEOPLE, COMMUNITY, CHURCH AND COURT SYSTEMS. HELP US SAVE OUR SON'S.

I know you want to hang 'em. Understandable. But so sad for all of us to see more young people throw their lives away.

I'm familiar with the neighborhood where this happened. Those boys and all their worthless little gang banger friends have been in trouble at school and with the police many times. Two of them were arrested before for taking guns to school, and one of them has charges for assault and shooting into a residence. They are known drug dealers. Nobody that lives around here is surprised that this happened. We are saddened, but not surprised.

I concur with the comments that these three thugs need to be used as an example of what will happen if you take another person's life. I know that Mitchell family and know that they are a pillar of strength in that community and has been for decades. However me knowing them does not cloud my judgement as to what I think should happen to these three. We take one step forward with black leaders championing our cause in Jena, LA and at the Justice Department in Washington, DC to have all of that wiped out by our youth going out and committing senseless crimes such as this. My prayers goes out to all four families, because the families of the boys who committed this crime are also suffering a great loss.

The Failed Campaign Promises of Jay Gaither
November 12, 2007
To the Lenoir-Rhyne and Ridgeview Communities and Current Representatives:
These people supported Jay Gaither in his re-election campaign and also share in the responsibility of holding Jay accountable in keeping his campaign promises concerning the aggressive prosecution of The Westmont Murderers - Donald Simpson,17 (currently on the loose in the Hickory Metro area); Christopher Wright 17, and Damion Armstrong 16.
Mr. Joe Lutz; Attorney Bob Thomas; Senator Don Kincaid; Senator Ken Moore; Hon. Bill Stone; Hon. Mary Pittillo; Hon. J.R. Simpson; Mr. Eddie Grindstaff; Mr. Dan Kuehnert; Mrs. Lee Love; Mr. Robert Love; Mr. Jerry Norvell; Mr. Frank Patton of Burke County; Hon. David and Mrs. Sybil Stewart; Hon. Gary and Mrs. Linda Whitener; Hon. Bob Hibbitts; Dr. Grimes Byerly; Mr. Jeff Cline; Mrs. Sibyle Hager; Mr. Dave Leffler; Mr. Jason Richardson; Mr. Sonny Roseman; Mr. Charlie Trefzger; Mr. and Mrs. Rick Ward of Catawba County
The Westmont Murderers took the life of Mario Anthony Mitchell, in broad daylight, on November 17, 2007 at the Westmont Apartments in Hickory, North Carolina.
This would not have happened if Jay had kept a few of his campaign promises listed below:
“District Attorney Jay Gaither has put criminals in the area on notice that criminal acts against our citizens will not be tolerated. Recent cases involving shootings into houses and cars have met with justifiable stiff sentences. The 25th Judicial District Attorney and law enforcement have done their jobs and we are safer because of it”.(A quote from Jay’s campaign website).
“I look forward to us moving as a community that recognizes public safety as a vital part of our area’s economic future,” Gaither said.“It is my goal to continue aggressive prosecution of drug dealers, career criminals and sexual predators.”(Jay’s quote)
District Attorney Jay Gaither continues to show that he cares about our people and works to make our area safer.(Another quote from his website)
Jay serves on the Board of Directors of the Juvenile Crime Prevention Council
Surely he could have done something about Simpson, Armstrong, and Wright
who are all currently under 18.
Jay Gaither established the Habitual Felon Task Force in 2005. The Task Force includes representatives from the District Attorney's Office, the North Carolina State Bureau of Investigation, Catawba County Sheriff's Office, Hickory Police Department and other law enforcement agencies in Catawba County. The Task force has been expanded to include law enforcement agencies in Caldwell and Burke counties. The Task Force has succeeded in placing increased emphasis on prosecuting career criminals and imposing lengthy sentences to keep repeat offenders off the streets.(Simpson is a habitual/repeat offender.
Please get on the phone and call the Catawba County Courthouse to express your disappointment in the District Attorney’s office in allowing Donald Simpson to freely roam the streets of the Hickory Metro Area. I have been told that people are being disconnected when they call about this matter, but call anyway. This is not just for Mario, but it is for everybody who has lost a loved one to habitual offenders and who live in Jay Gaither’s 25th District.

well i know for a fact that mitchell's family has some drug dealers, as well as gang members in it. i believe this is all gang related. if we brought back hanging people in the streets, it would solve a lot of crime. thugs would stop, being thugs. we would have a more productive community, instead of a criminal one

what do you mean by stating,"well i know for a fact that mitchell's family has some drug dealers, as well as gang members in it. i believe this is all gang related."? how can u honestly said that about someone being murdered!! mario was not a gang member!! if he has others in his family that are, as you say, dealers and gang members, why hasn't any violence been directed towards those?
the mitchell family is like my family, i have known them my whole life and to read what you said was totally false!! its people like you that always keeps stuff going!!

Jay Gaither needs to focus more on doing the job he was elected to do and less time doing political "favors" for his buddys. Favors that have NOTHING to do with the DA"S office. Specifically, his "buddy" Donnie Young. Donnie is Jay's front man who does his dirty work so Jay does not have to get his hands dirty. Someone needs to investigate Donnie.

I know of one incident where Jay Gaither received a ticket after knowingly parking in a handicapped spot in uptown Hickory. He GAVE it to a city hall employee, laughed with her and requested she get it fixed. What do you really expect from him?
