I hope this lady doesn't win her case. Otherwise, every woman seeking an abortion will try to sue for emotional trauma after their pregnancy is terminated. Yet one more reason why late term abortions should not be allowed except under extreme circumstancs.

This is the height of irony. It's disgusting! They never should have done an abortion at 23 weeks. Anyone knows babies born at that stage can survive. But for this woman who did not want a baby to now claim "wrongful death" is pathetic. She's clearly just trying to get money because she thinks she can. Go get a job and pay your taxes and use birth control, for god's sake!

I've tried to adopt an infant for two years. It's sad that all of these deaths (abortions) take place when there are people like me who would have LOVED to have adopted the baby.

This case will hopefully put the abortion issue in the spotlight, resulting in much needed legal clarifications.

The basis of the lawsuit defies logic. The woman went to the clinic specifically to abort - have killed - her 6 month fetus. Indeed, that is what happened. Now she screaming murder.

This can only mean that if a doctor kills the fetus in the womb, it is a legal abortion and everyone is happy. No crimes, no malpractice. But if the fetus exits the womb alive, then not making every effort to keep it alive, even though that was not the mother's intent, is cold calculated murder.

It makes no sense in any context - legal, ethical or moral. None.

Let make your point another way. You are saying that if the fetus is intentionally killed in the womb, it is a legal abortion. But if the fetus actually exits the womb not dead, then not making every effort to keep it alive is murder.

That makes no sense legally, ethically, or morally.

I am not saying that the baby should have been killed that way, but are you serious? You go down to the abortion clinic to terminate a pregnancy, in other words kill the baby, and now you are filling a wrongful death suite. You were going to kill the baby anyways. Thats what you went there for.

The issue here is not whether abortion is legal or not. The issue here is WHEN abortion is legal, that is at what point, and under what circumstances, does abortion become murder?

Much of the abortion debate has centered around the ethical controversy of when does a fetus become a human being. In later term abortions, which the pro choice fanatics insist is guaranteed by Roe v Wade, the ethical question becomes life in the womb versus life out of the womb since a 6 month fetus can, and has, become a living human being upon exiting the womb.

This case renders the issue in the most simplest of terms. The woman wanted the fetus killed, as long as the killing was done in the womb. But since it wasn't done in the womb, she is now claiming someone murdered her child. At best that should pose a serious ethical dilemma, but more importantly, it is a vexing legal one.
