I have heard from several people in Herrin that Energy PD has been showing up at Herrin PD arrests when it involves a car being towed. Then Energy charges the car owner $400 to get the car back and then you have to pay the tow bill . Anyone actually have this happen or just rumor ??

It is true! They call it a city ordinance. It was passed by the city council. I was told by a police officer that it can be waived and has been in several cases. However, I asked the police chief to waive or reduce the fine for a disabled person that only receives SSI and he refused. Heartless!

Curious , The police chief can't be the hearing officer, it must be a licensed attorney. Have that person ask for a hearing!

I was told you had to request a hearing within 48 hrs? We were too late. Plus I was told that no one ever has won a hearing and if you lost there was an additional expense that had to be paid! My biggest complaint was that the Chief of Police lied to me and said that there was nothing he could do? Then later told that it was at his discretion. I could understand if the vehicle was used in a crime or DUI, but a traffic violation?$400? Please? So much for honest government.

Find out who the City Attorney is and advise them in writing that you want a hearing. The 48 hour rule or whatever Hours they set, isn't forcible. As part of your due process they must give you the opportunity to be heard. The Police Chief doesn't have SQUAT to do with it, the hearing must be conducted by an attorney. What you want to ask the Attorney is the fact basis for the $400 or whatever it is. Bet you they can't justify the fee as you can't just grab a figure out of the air.

That is the point, there are no arrests involved in most situations. Taking your car for traffic violations.$400 city ordinance and no arrest?

Is Energy pd taking over the duties in Herrin. You see Energy cops patroling all over Herrin night and day. In fact they are more visible than the Herrin cops. I am waiting for the day that the Energy police chief kills an innocent person when driving down Park Avenue 70 or 80 MPH with no emergency lights or siren when there is no emergency other than getting to the coffee shop. When is the Herrin police chief and mayor going to take action on another town patroling the streets of Herrin?

First of all energy cops arent towing herrins arrests lol that is just stupid! herrin cops tow their own cars and energy tows their own.... and if you lose at a hearing for tow you are NOT charged any additional fee just the $400 or $200 you posted as bond. Its simple if you have a question dont listen to ppl that dont have a clue or heard from someone else..... just go to your local cop shop and ask!! DUH
