Today's Telegram..."Due to the county Legislature’s failure to follow legal regulations on the sale of public-use land, the public will now get a chance to vote on the sale of Country Manor Adult Home to Valley Health Services.
The Legislature learned Wednesday its sale of the county-run adult care facility has been voided because it lacked the necessary votes and didn’t have a law in place to avoid a public auction.
The resolution to approve the sale in April lacked the necessary two-thirds vote of the Legislature, passing with 11 votes instead 12, and the county did not have the authority to make a private sale of the facility, according to county Attorney Robert Malone.
A local law must be passed in order for the county to be able to sell Country Manor to VHS exclusively, rather than selling it at a public auction to the highest bidder, Malone said.
The Legislature on Wednesday set a public hearing for Aug. 11 at 6 p.m. for the local law.
But the local law will not take effect for 45 days to allow for the permissive referendum process, according to Malone. The referendum process allows a member of the public to collect a set number of signatures to call for a public vote on the law.
The number of signatures necessary is based on the number of ballots cast in the last governor’s race, which Malone said was 19,328. A referendum petition must contain 10 percent, or at least 1,933 signatures, of that total to call for a vote.
Without a petition calling for the vote, the Legislature can vote on a sale of the facility to VHS after the law goes into effect, Malone said. The oversight was discovered during the sale process, he added.
An agreement between the county and VHS, a Bassett Healthcare affiliate, must also be renewed in order for the sale to move forward.
The county had agreed to pay VHS a total of $1 million over four years to take over ownership of the facility, which traditionally was operated at an annual loss.
A $4.2 million state Department of Health grant was awarded to VHS to assist in the takeover.
It is unclear how the sale will be affected by the oversight, as there are several deadlines involved in the funding.
The grant has a 24-month deadline for expenditure, and the clock started ticking in October, several legislators have said.
Facility employees, residents and affected family members are also, once again, left guessing as to their future."

Can you believe the county with 8 county attorneys giving advise,they didn't know they needed more votes or follow a different procedure to sell the County Manor home? Only in Herkimer County would you pay for such incompetent legal advise. If this costs the millions in grants that could have fixed that place up, Malone and company should have the decency to resign. If he doesn't have any principles left, then the legislature should fire him. If the union gets the signatures to put this to the voters, we will loose the opportunity to fix up the place. There is no excuse for the lousy legal advise. Malone is incompetent. He should have done the research on such an important issue and not assume he knows it all. He clearly has demonstrated he knows little about governmental law..so why do they keep him?

What astonishing incompetence!

Absolutely, Malone and other lawyer who reviewed this deal should be summarily dismissed.

I suggest that Malone be summoned before a formal session of the county Legislature.

After some introductory remarks, the Legislators will stand assembled before the incompetent boob of a lawyer and grab their crotches as they declare in unison,

"BOB, YOU REALLY PUT OUR BALLS IN A VISE!"

It would be fun to watch that on channel 99..but they probably would cut the voice on the recording!! Someone needs to be held accountable for this. Or the taxpayers will take it on the chin again. Each legislator must go on record calling for Malone's resignation! He's too busy kissing the boys A** to do his job. Throw him out and save on Health Insurance. His apologies are useless if the grant is lost.

Malone is a joke. Since when is ignorance of the law a defense for an incompetent attorney to use. Thsi is just another example of Malone saying and doing what his boy bosses want. He agrees with them whether it is legal or not..cause if he ticks them off..he loses his high paying part time job WITH BENEFITS! He should resign and if he doesn't they should throw him out. He makes what $70 - 80K year for a part-time job and he doesn't know the law. When was the last time he sold county real estate other than property they took for back taxes..he got the dumb gene in his family. His brother is on the county payroll..is he any smarter...not..how about Franchi getting $70 - 80K for part time work too. Iocovozzi makes $45,000..where's her smarts on this. There are enough of them in that office..if they don't sell property like this often..then do they understand the word RESEARCH...ship them all out.

This is a typical example of arrogance on the part of County officials. As usual, trying to do an end run around the law has gotten them caught with their nuts in a vise. Maybe if they weren't so busy defending blatent sexual harrassment on the part of one of their leaders, they might actually be doing their homework. These people all need to go! They are all a bunch of incompetent idiots who are only interested in what benefits themselves and their enablers. Mr. Malone and his bunch of idiot lawyers are a big disservice to this County and have cost the taxpayers a ton of money with their incompetence. Obviously, they don't believe in legal research.

Does your Doctor know every disease? Does your mechanic know how to fix every problem with your car? Does YOUR lawyer know every law? Just another example of total incompetence on the legislature's part, as well as it's attorneys(who must also be a bunch of know nothings). On the other hand, based on the legislature's past dealings, maybe they thought they could just sneak it through without anyone knowing. Very few legitimate watchdogs there, to keep looking out for us, Helen Rose being one of them.

Valley Mess is correct: let the public vote on this. Instead of another backroom deal, let the public decide once and for all if we as a County think that this facility should continue to exist as a county-run place or to get a FAIR price for it. Backroom, secret deals are never to the taxpayer advantage, but are only designed to benefit the insiders. These clowns on Mary Street need to understand they work for us; for too many years they have got away with doing the people's business in private and at the taxpayer's expense.

Malone is so busy feathering his own nest in the county making $75,000 a year for part-time INCOMPETENT work, he failed to research the law and failed to properly inform the INCOMPETENT legislature how to handle giving Country Manor away for $2.00 and $1,000,000 over 4 years. He called it tough negotiations that he went through with the VHS attorney...you've got to be kidding me. It was his responsibility to know the law or research the law.Instead he gave bum opinion and now VHS could loose the multi-million state grant if they can't get title of the property so they can spend it before the fall of 2011. Malone thinks he should get a pass because he admitted that he didn't know the law that governed this. Remember he's the same one advising the county on how to screw the village of Herkimer on the jail. Should we trust him and his cronies on that. By the way, why should we take in prisoners from other jails to pay for a new one? DUH...if we need to build..and many are not sure we have to..let's build only what we need and not ASSUME $$ from other counties to pay for it. Boarding in is not guaranteed $$. And HC citizens can no longer to make up the short fall. These guys need to talk dollars and cents to us citizens. Do it on Country Manor and the jail and then trust the citizens to understand the situations. Trying to buffalo us with BS only makes us more suspicious. The county manor deal is prime example..they sneak around making their deals and didn't open it up for public scrutiny..maybe just maybe there was a smart citizen who might have asked a question that could have prompted Malone to do his job and look into the law..wishful thinking I guess.

Hey Perry Mason, The Attorney should be smart enough to know when he needs expert opinion! Malone should have called in the EXPERTS and done his research. That's what my Doctor does when he's unsure or knows it's out of his league. That's called a referral to a specialist. The question is why didn't Mr. Malone do that? He might rather be labeled dumb or misinformed rather than the possibility he ignored it assuming dumb public and a happy good 'old boys club who wanted the whole thing to slide through. That makes you wonder about his other "legal opinions" that the boys have used to push the jail, labor contracts ,,real estate pro pert tax sales etc. We better watch him closely. He's got a great salary and empire to protect.
