3202. Public schools free to resident pupils; tuition from
nonresident pupils. 1. A person over five and under twenty-one years of
age who has not received a high school diploma is entitled to attend the
public schools maintained in the district in which such person resides
without the payment of tuition. Provided further that such person may
continue to attend the public school in such district in the same
manner, if temporarily residing outside the boundaries of the district
when relocation to such temporary residence is a consequence of such
person's parent or person in parental relationship being called to
active military duty, other than training. Notwithstanding any other
provision of law to the contrary, the school district shall not be
required to provide transportation between a temporary residence located
outside of the school district and the school the child attends.

when I was in 9th grade my mom and I moved to Herkimer from Ilion. In order for me to stay in Ilion we had to write a letter to the superintendents of both schools requesting I stay in Ilion schools it was approved by both supers, didnt have to pay any tuition. A recent wexample is my friends kids all go to Ilion schools and they live in Mohawk and I know they dont pay tuition to go there.

The state does have voluntary open enrollment policies on the books, but the rules will vary district by district and few really allow it. Both schools have to agree, tuition CAN be charged, there is no transportation funding, etc.....it is not an easy road and a parent has to do a lot of legwork.

It takes a whole new level of jacka$$ to take the one bright spot for those kids & turn it into a merger slam and more superintendent trash talk. For god's sake feel better about yourself so you don't have to delight in constantly reminding these kids of what they already know - that their school will change. Let them have one moment at least.
