County refuses to air BONO'S dirty laundry

Herkimer, N.Y.—

"The county attorney’s office has denied The Telegram’s request under the Freedom of Information Law request for the results of an investigation into a sexual harassment complaint filed by Legislator Helen Rose against Legislator Vincent Bono.
“Since the complaint was unfounded, the disclosure of the documents you requested would constitute an unwarranted invasion of personal privacy under...the Public Officers Law (Freedom of Information Law),” Charles Crandall III, assistant county attorney, wrote in the response.
The county Ways and Means Committee voted unanimously, 6-0, that the complaint was “unfounded,” he added.
During an executive session July 21, the committee voted that the alleged incident did not violate county anti-harassment policy. This decision was the only information related to the complaint that the committee released through its meeting minutes posted on the county’s website.
The complaint, released to The Telegram by Rose, alleged Bono made comments and a gesture in an attempt to bully her “into submission by publicly humiliating her with sexual references.” The alleged incident took place in the hallway following a legislative session, according to the complaint.
Rose, D-Herkimer, is yet to give her official response to the committee’s decision. But she has voiced concerns with several committee members, whom she said participated in the discussion that led to the complaint, and the decision to allow them to rule on the complaint.
As for the disclosure of information related to a sexual harassment complaint, Crandall cited a 1997 opinion of Robert J. Freeman, executive director of the state Committee on Open Government.
Several legal decisions that allowed for the “permissible rather than an unwarranted invasion of personal privacy” of a public employee involved some sort of disciplinary action, according to the opinion.
“However, when allegations or charges of misconduct have not yet been determined or did not result in disciplinary action, the records relating to such allegations may, in my view, be withheld, for disclosure would result in an unwarranted invasion of personal privacy,” Freeman wrote.
There have not been any opinions since from Freeman that conflict with this opinion, according to Crandall.
Bono, R-Schuyler, has stated he believes “others involved” in the complaint did not follow the rules for dealing with potentially sensitive matters."

Who's surprised that Bono wanted Rose to shut up about what he did. I don't think the policy requires that. And then the County doesn't want anyone to know what Piseck and Weakley had to say about what happened BEFORE and AFTER they voted that Bono didn't do it!! They're all involved now because they let the bogus committee make the decision. To bad Rose didn't know Bono was going to grab himself and be such a pig, she could have taped that. It would make better copy than the legislature on channel 99.

We need to understand that this happens because they can get away with it. I hope Rose sues them all, but if she does, we will end up paying legal fees to defend the county. Even if Bono did these things, maybe that's not enough for a case against them. but we will still end up paying to defend Bono and the rest of them. Something is real wrong here. If the county loses, Bono should have to reimburse the county for the legal fees. Rose should pay her own. Wow wouldn't a simple apology been a lot cheaper in money and time. If he doesn't think he grabbed his crotch, apologize for his words and whatever other hand gesture he made that the reporter saw. Would it be too much to expect him to do what is right? No but now we have his comrades lying for him. They have put themselves in a corner and can't save face. And we loose $$. How can they be stopped and who will stop them? No easy answer.

How surprised are you that the Telegram finally is pursuing a real news story? I am thrilled that they used FOIL to research the issue. They have been turned down, but there is an appeals type process.

The thing is, with the current crew in the legislature, it is just one thing after another. It is embarrassing, and I'm tired of it. The best thing is to encourage good people to run. Let there be competition and retire the current corrupt circus. I see no accountability to taxpayers at all.

Astronaut (Blower) As I said before, Mrs. Bono would take one look at "your package" and burst out laughing. She'd probably send your wife a sympathy card. As for spitting on Mr. Bono, I beleive that's assualt. Sexual harrassment and assult: that should put you in jail for a while.

Can you read? She most definitely reported hearing Mr. Bono's reference to his genitalia and that he made a related hand gesture. Just saying it didn't happen doesn't make it go away. I too support the Telegram finally trying to get to the bottom of some the BS that is going on. Bono is a little man who should be made ever smaller and when that happens it will hopefully take Peiseck and Weakly down a peg or two. Mr. Smith isn't doing a very good job of showing leadership by any measure other than business as usual. Shame!

These guys are immune to action by the citizens because their election is 1 1/2 years away, We tend to have very short memories and they know it. Bono and his boys need to be held accountable for what they have allowed to happen. My granddaughter works for the county. It will be open season on woman in that building because the abusers know there is no teeth in the county enforcement. How can you hold the legislature to a different standard than you will hold the employees? Answer you can't!! How sick this becomes. There doesn't seem to any honest men in the room to challenge this mockery. therefore we the taxpayers will loose on several levels.

There is definitey not enough outrage. Legislaors for years have treated female county employees differently than they have the male employees. I have personally witnessed that myself. They don't appoint women unless they have "connections". Witness Pieseck's girlfriend, Mrs. Maneen, Phyllis Spinner, and previous deceased male legislators' wives. It will definitely be open season on women; there is no way that a male will successfully be charged with harrassment when there is a precedent set the by the Ways & Means Committee members themselves (the very committee members who would have to rule upon any action). Any lawyer worth his worth would have a field day with them in a lawsuit. No woman would win their case regardless of how bad the harrassment was.

It's one big family up at the county. let this be a lesson to all the next time elections role around. All we need now is in your face Brennan. Everywhere you turn he's there. Aney must really want him in bad. Can all these people who have given him permission to put his signs on their property be voting for this jerk?? I hope not.

While these guys tried to deny Mrs. Rose a fair hearing, I think the voters know what happened and it will impact how they vote. It is so much more than the people on that committee who should be held responsible for the cover-up. Keblish is a military officer, Stone is a restaurant manager and Mrs. Maneen is a woman. Have they no courage at all. Wednesday is the first meeting since they did this. I hope these legislators who weren't in the room will speak out about their concerns. If they don't, they must be charged as accomplices. Shame on the lot of them.

they aired it..but showed none of the boys can even smell a rat let alone see one. They showed they are all in on it together. Korce is the biggest farce. Here he has daughters and thinks it is only harassment if the person can be intimidated. He needs training too. Maybe the Casale group offers sexual harassment training and they can get another contract with the county!!

We had the chance to vote out several of them, but you guys messed it up and didn't vote against them. People can talk and act all tough that they are going to vote out the current people, but when it comes down to it, they are all pu@@ies and vote for what they already know, rather than take a chance and have a newcomer start from the beginning. These guys have been there for many many years, and you are all afraid of what may happen if new guys start from scratch. You are all pathetic with your tough talk. Put your money where your mouth is and REALLY vote against them on the next election, not just this all talk boloney.

It should be interesting to watch the meeting Wednesday. They will be hot on the village turning them down, and looking over their shoulder to see what Rose will do. Do they really think she will ever shut up? They just can't figure out how to deal with someone who is in there to really try to run clean open government. It would be so refreshing is any of them made a statement of how shameful their sham committee review of the sexual harassment complaint was. I guess there is always hope for integrity.
