If she was actually convicted under the Leandra's law the first time, then it should have been a felony. Might have been plead down. This time around, that's probably not going to happen. The DWI with a child in the car (Leandra's Law) is a felony charge. Up shit creek for sure.

I saw the article on WKTV and I have to question why she was arraigned in German Flats town court when it happened in the Village of Herkimer, Town of Herkimer. Strange.

No full time judge in the village. Sometimes you get one. Sometimes he's at work.

I guess it won't matter anyway since these are felonies it has to get bumped up to County court.

Thanks for the reply though. I never understood why I see cases getting arraigned in a different town than where it occurred.

A DWI charge that falls under the legal requirments of the "Leandra's" law makes an ordinary misdemeanor DWI a felony charge. One does not need to be a lawyer to know this or know exactly where to find NYS statutes.

The resulting "Leandra's Law" elevates the crime of drunk driving with a child in the car to a Class E felony punishable up to 4 years in prison; if the child is injured, 7 years; and if killed, 15 years. It also mandates ignition interlocks for the cars of all convicted DWI offenders for a minimum of 6 months.

What difference would that make? You make the ASSumption that someone else must be an attorney to know what Leandra's Law is and you've been shown resources to KNOW what this law is WITHOUT having to be an attorney.

The justice system doesn't give a darn if they allow those convicted of DWI's to continue driving UNTIL they slam into one of their people. You can't keep most of these drunks from driving again even after taking away their licenses. They usually were driving without license, registration, or insurance anyway. Lock em up.
