I don't care for the way the authorities are characterized here, but the world has changed and you can't expect the law to hold your hand 24 hours a day. It's up to the judge to give appropriate sentencing, and prison overcrowding is an issue many counties face, so short sentences are becoming the norm. Even for what previous posters have called repeat violent offenders.

Sign of the times. Get used to it or leave.

Then clearly you don't understand the judicial system, which draws into question whether you actually are retired pd.

See, it works like this. More than 90% of cases prosecuted are plea bargained. By law, judges CANNOT change the terms of plea bargains and are bound to sentence defendants to what was agreed upon. So, blame DA's for going light. The judges' hands are tied. The exception if if the cases actually go to trial, either jury or bench trial. Then the judge has discretion over the sentencing.

BTW, overcrowded prisons is NOT an issue Counties face. It is an issue the State faces. Prisons are STATE facilities and jails are county facilities. Again, you not knowing the difference seriously draws into question your claim to be retired pd.

You apparently have never worked in corrections or law enforcement at a county level or local level. While I don't entirely disagree with respect to plea bargaining, let me assure you, overcrowding is just as alive and well at the county level as the state level. I am not quite retired from law enforcement despite your insistence otherwise, Fred hit the nail on the head. You can't blame the cops for a system that allows people to plea down over and over and over. Unlike on a federal level, local judges do play a role, albeit limited, in the plea bargaining process. Do they typically follow plea recommendations? Yes. Do they always? No. Only those of us that work in the system really know the intricacies. The rest just think they do.

Overcrowded, yeah right. That's why nearly HALF of OCJ is vacant and about the same vacancy at Fulton County.

Its not "do they typically follow the plea bargain". IT is the MUST follow the plea bargain or not allow any of it. It is all or nothing with a plea deal as far as a judge is concerned. Unless it went to trial, that is the ONLY thing a judge can do regarding a plea deal. And that is the law, fake LEO that you are.

Its obvious you're talking out of your ass.

What's the difference between County jails and State prisons? You've already shown your ignorance by interchanging county and state incarceration.

Has happened to me, too, when my daughter was being harassed in front of our home by kids from the high school. HPD made up excuses and side stepped responding. Said to call back another day when the "youth officer" was on duty. Bunch of BS. Once the kids heard I actually did call the police, she never had a problem after that. Yes, HPD are pretty useless.

But it still does not answer the question regarding all these "murders" supposedly in Herkimer's history.
